Question

What constitues where a person is legally 'found'? My wife is filing for a divorce in another state, and she has been in that state for the required amount of time, yet her name is on a lease in my state, as well as utility bills. She has our two children with her and they have not been there for over 180 days. Do her actions have an validity or would I be justified in moving the case to my state?

Answer

Your description shows that you may have grounds to get the case moved. Ask your attorney to investigate the laws of the state where she filed.

Good luck

Answer

You must meet with an attorney to discuss the specifics of the UCCJEA
