To be honest I personally don't agree with the answer on top of this one. I have my lip piercing done for my 15th birthday which is in December however I got it done in October so I was still 14 ( almost 16 now ) And getting my lip pierced did not hurt me at all. Didn't feel a thing. How ever it hurt me a little afterward but thats cause of the blood that was drying up and making the piercing stick to my skin and every time I touched it, it would hurt a little, less then a pinch and it was only for a day or so. ( my lip also did not swallow up)But thats just my personal experience, and everyones pain levels are different. On a scale from 1-10 I would give it a 2 since it only hurt a little afterwards, but thats just mine opinion.

Make a complaint with the state dept. of labor (and US Dept. of labor) regarding the lack of pay. Why in the world are you so concerned about whether your father paying that loan is considered 'financial support' to you? As they say 'the devil is in the details'. The basic problem isn't that we get hung, its that you are asking a question that can not be answered the way you want with out the details and more over even if you had a yes or no answer it wouldn't help you much because it's the wrong question. It's the wrong question because 'legally' the term 'financial support' doesn't mean anything. So until we know what importance 'financial support' has - we really can't answer your question. The Illinois Forcible Entry & Detainer Act says you can maintain an action to evict if a person takes possession with permission but that permission ends -- in a situation like this it usually would require a 30-day notice. However, the problem is that one owner apparently is still granting permission. And each owner has the right to control the entire property. This is what happens especially in tenancy in common situations where there are 2 owners. If you had a 2 to 1 situation, then a court may find there is an oral general partnership and that the majority controls, but when there are only 2 owners, this is called a deadlock. About the only thing you might be able to do is force a sale of the property through partition, and the threat of partition may be enough to loosen the situation up, or kill it. Time to talk to a lawyer and lay out all of the issues.

This is one of the problems you get when standard possession orders and other form language is used. There isn't a perfect answer because the possession order is supposed to provide strict deadlines and it isn't. So the best thing you can do is work out an agreement with the other parent on when you need to return your daughter.
If you can't work out an arrangement then it becomes a question of whether it is worth it to have the other parent bring an enforcement motion (if the other parent would do that) and leave it up to the judge to interpret the possession order however he or she prefers. Often for young kids the way it will be handled is that the court will just determine the dates of Christmas visitation based on the public school calendar but in this case there is an argument to be made by a good attorney that since your daughter is in an educational program that the center's schedule should govern.
What you want to do at very least is try to work out an arrangement with the other parent even if you know it will fail. If you decide you want to fight over the when visitation ends you at least want to show that you kept your daughter due to an ambiguity in the order, rather than ignoring the order, and you tried to reach a resolution between the two of you. It's hard to prevail on an enforcement action under those facts (but not impossible).
If you are unable to reach an agreement with the other parent it may be worthwhile to turn over your daughter on whichever date is earliest and avoid a fight. I would also suggest if you cannot reach an agreement that you consult a lawyer about your options and what makes sense in your situation. There may be some other options on the table if you are interested in spending the money and/or incur the risks involved in the other options.

It appears that 18 months passed between the doctor visits, and you apparently did not pay the first doctor in that 18 months (before you had trouble). Another year has passed, and the "incompetence" has arisen when collection calls start coming in. The statute of limitations for malpractice is 2 years, and for a foreign object left in body, one year after discovery. You can certainly see a med mal lawyer (very soon) but a case cost thousands just to get started. If this is really just to not pay the bill (which appears likely), then you'll probably have to deal with it as a collection case not a med mal case.

My husband has been incarcerated in California for 20 years. He was convicted of 2 second degree murder charges and sentenced to 2 25-life terms following a dui accident that resulted in the death of 2 pedestrians. (He is honestly not sure if he was driving the vehicle at the time or not and was not found in the vehicle but was found injured 1/2 a mile away) His appeals exhausted, and much time has passed, but he has recently been advised he could file a motion to recall the remittitur asking the courts to reduce his charges to vehicular manslaughter. He has also been advised based on his transcripts that his Miranda rights were not given or recorded correctly, and a blood test done prior to his arrest was not "legal". Is someone feeding him a dream or could it be a Motion to Recall the Remittitur could get his case before a judge?

I don't see how he could get the remittitur recalled at this stage. But he can probably bring a habeas corpus petition instead. That's an alternate way to challenge his conviction.
But the availability of the procedure does not mean there's a good chance it will work. Since you don't say where your husband's recent advice came from, I am skeptical -- especially if the source is the same person who thinks the remittitur can still be recalled.
Your question does not say whether your husband had a trial or entered a plea. That's an important question. If he entered a plea, he has fewer options. Even if he was convicted after a trial, there are many hurdles in front of him.
Why does your husband think his Miranda rights were violated? Even if he can prove that they were, that won't necessarily doom his conviction. At most it would mean some evidence should have been kept out. If the remaining evidence was so strong that the tainted portion could not have made a difference, it won't help him.
There might be a good Miranda issue in your husband's case. But these issues usually are not subtle. His defense lawyer would likely have raised any plausible Miranda arguments. So would his appellate lawyer. The odds that they both missed such an argument but that your husband's mystery adviser found one seem rather slim.
Then there's the matter of the blood test. I have no idea why your husband thinks it might have been illegal. Maybe it was. And maybe the illegality would be a good reason to grant his petition. I would need more facts before I could offer any guidance.
The bottom line is that your husband might have a chance but should not get his hopes up. You and/or he should discuss his case with competent counsel to see how plausible his chances might be. Does the comment that his appeals are exhausted include state and federal habeas corpus relief? A motion to recall a remittitur would put the case in the Court of Appeal which does not seem an appropriate venue for the issues you mentioned. A motion to recall a remittitur typically involves some default by counsel in the court of appeal that needs correction which is not the issue you mentioned. Good luck.

The facts that a person is/was your friend and was down on her luck may not be decisive if a problem occurs later on. The law will tend to look, first of all, at whether the person became a tenant, or was merely a guest or possibly a lodger. All three are separate legal categories. You didn't say whether the place you were going to put her up was in your own home or in a separate place, nor whether you were going to charge her anything or give her the quarters gratis. You are safest if you charge nothing and let her stay at your place; that makes her a guest and she becomes a mere trespasser if you tell her to leave and she doesn't within a reasonable time. Your friend acquires the largest bundle of rights if she becomes a tenant, even if her rent is bargain-basement, which she would if she pays anything and gets a separate space. Even so, an eviction isn't usually horribly difficult, but in any case, you'd be best off with a suitable written agreement covering the basic terms and including her promise to depart "when that time comes." More specific advice would require more facts. There are lots of form rental agreements around, if that's appropriate in this situation.

If its not specifically addressed by the court order the ex-husband may still have some rights in the benefits. The wife needs to review her divorce decree or talk to her divorce lawyer about this. Am I subject to Florida law or Texas? I was served in Texas. Texas states the statute of limitations is 10 years and Florida states 20. It has been on my credit for almost 7 years. Should I let it expire or pay it? I now live in Missouri and have for the last 6 years. Does that make a difference?

The statute of limitations generally is applied as to where the case us. If the suit was in a gluteus Court, than the Florida period would apply in most cases. If they filed their suit in Texas, than Texas sol law applies. If they now register the judgment in z Missouri, it will be applicable against your Missouri assets for the Missouri sol period. As to whether to pay it, you didn't and probably could not provide enough information here, to advise one way or the other. You should consult directly with a debtor/creditor practice attorney in your area. Many offer a free or low cost initial consultation.

We had a great time, personally speaking. Very clean, little to no lines, prices were fair, and perhaps less "commercialized" then American counterparts. Less pressure.
If you're asking for only the negative effects of it, I'd say the distance for North Americans to visit. There are not nearly as many "package deals" available, compared to the parks of Florida and California.

Tyler was having some personal conflict with a friend. Because they were not getting along, he did not have any wish to communicate with this friend, the second party in this case, who we will call Justin. Tyler and Justin occasionally enjoy going out to the gun range together and shooting their guns together, of course, when they are on good terms. However, because of a dispute involving a night where Justin stole property from Tyler's home, while they were hanging out, Tyler no longer wishes to speak to Justin.
On the last occurrence of the two parties enjoying each others company, Justin accidently left his BB gun in at Tyler's home. He lives there with his girlfriend Madison. The property was stolen by Justin on that same day/evening. Tyler, after speaking with Justin and trying to resolve the missing item, decided to call his losses, and not go further in trying to obtain what was taken (Justin's hostility having much to do with this decision).
Madison woke up one morning, just a few days after the incident, to hear a loud banging at the back door. She is afraid and Tyler is not there. She goes to the door and asks who is there, and in return is responded to by Justin who says "let me in now! I need my bb gun back and am not leaving until I have it!" She responds, "Tyler is not home, which is clear because his car is gone. I am not letting anyone in while he isn't here. I am not the home owner, and you are his friend, not mine. I am sure Tyler will return it as soon as he gets home from work. Was this BB gun taken from you?" "No", Justin responds, "I left it here. But I will not leave until you give it to me, or I will call the police". He is yelling and disrupting the neighbors in the process and Madison becomes aggregated. She then says, "it was your mistake to leave it here, and I don't know where it is to begin with. However, even if I did, I refuse to open this door. You are hostile, for one, and you have taken from us and our home. We were nice enough to spare you from trouble from the cops. Leave the property. As soon as Tyler gets off, I will tell him you came by, and we will return it as soon as we can". Justin then gets in his car and leaves. Tyler later decides to go to Justin's home. When he texted Justin, he responded by saying he was not home. Tyler was already on Justin's road, and could see his car parked in front of his home. Justin lives with his father, who is the owner of the house. Tyler and Justin are normally under much different terms, and it is very common that either parties will stop by each others houses without notifying the other. They are very comfortable and familiar with each other and the way each works, which is why Tyler proceeded with the following actions, without any thought regarding legal matters. He pulls into Justin's driveway. He does not want to have confrontation with Justin, due to the hostile and intolerant responses. So Tyler approaches Justin's vehicle, opens the unlocked car door, and proceeds to return Justin's bb gun. He was not given permission to enter. Justin and his Father exit their home, at that instant. They are both acting in a manner that causes Tyler to feel threatened. Justin is making trespassing accusations. He tries calmly telling them that he was only returning property. The two were watching home from their window, and witnessed him doing so, as well as the fact that he had not taken anything from the car, which didn't have any property in it to begin with. He and his dad wont hear it. Justin uses a baseball bat to then bust out one of Tyler's car windows. When Tyler then enters his car to leave, the father yells that he is calling the cops. After leaving, Tyler calls his father who is the captain of the county jail. He advices that Tyler go to the police station, and let them know what happened. Tyler does so, by explaining the situation, and admitting to entering Justin's car without permission. When he tells an officer what had occurred, he was not informed that he was being recorded in any way. No officer was writing anything down, and because he did not have any warrants nor fled from the scene of a crime to his knowledge, he was not there to make any sort of confessions. He was simply implementing information, with the intention of avoiding any further complications, and to make sure he was free of any trouble. From there, he goes home. Justin later calls to inform him that he and his father decided not to press charges, after talking to the police. Tyler then decides that he will not press charges in regards to his broken window, although the damages are expensive. a week and a half go by when Tyler's dad calls him him that he has a warrant for his arrest, the charge being "entering an auto with the intent to commit a theft or felony". The state was pressing charges based on what he told the police, and he was in fact being recorded that day at that police department. What should he do? He was not informed that he was being recorded, at all. Nor was he in any way, intending to commit a theft or felony. Also, the parties involved chose not to press any charges regarding him trespassing. They stand by that, still. They were hostile and are now very sorry that they acted that way, while Tyler was only returning Justins item, and did it in a way that he could best avoid conflict. please help me. How can that determine his intent? How can they incriminate him based off of his own detail of the event? The police office says that he gave them the information needed to proceed in charging him with entering an auto. They did not entail the part about his intention being to commit a theft. There is no charge for entering an auto that doesn't entail the intent to commit a theft. If he is charged, it should only be for trespassing. He admitted only to entering the car without permission.

The proper procedure when someone dies is to probate an estate. If there is a will, the person named in the will is the personal representative. If there is no will, then its usually next of kin or any other party. You indicate there is no spouse or children. Are there grandchildren? Siblings? Nieces or nephews?
The task of the personal representative is to figure out what the deceased person owned and owed, pay the bills/just debts and then distribute what is left to the beneficiaries.
You indicate that there are a lot of debts. If there are enough probate assets to pay claims, then all claims must be paid before any heirs get anything. If there are more debts than assets, claims get paid in order of priority. Priority is administrative expenses (paying an estate attorney, costs of probate, paying the personal representative a commission, etc. are administrative expenses). Then come funeral bills up to $3500, then taxes, then health care costs incurred in the last year prior to death and any Medicaid liens and then dead last are things like credit card debts. If money runs out at a higher level lower level creditors get nothing. However, the personal representative is required to notify all the creditors about the estate. The personal representative also has the ability to compromise any claims. If there are probate assets, I would suggest that you go and see a probate attorney who practices in the county where the deceased lived at the time of his/her death.
There are some cases where probate is not necessary, as in where the deceased had no probate assets. An example would be someone who lived in a nursing home and who was on Medicaid. Another example might be someone who rented an apartment, did not have a car and who only had a joint checking account with a relative or friend.
In such case, what I suggest is that the next of kin write a letter and send it certified to all of the known creditors of the deceased. The letter advises that the deceased had a debt with the creditor, that the deceased has died (send a copy of the death certificate), indicate how the next of kin is related to the deceased (such as the writer is the nephew or whatever), advise that the next of kin is not liable for the debts of the deceased, that the deceased owned no assets justifying probate and that no estate will be probated. Advise that the creditor should not bother the next of kin any further. That is enough for cases where there are no assets.
However, whoever is the next of kin should consult with a probate attorney to find out of probate is needed. Failing that, contact the clerk of the probate court and find out if probate is needed. If so, the clerk will have the necessary forms for the next of kin to commence the process.

We had a court order that he would pay 806.00 plus arrearages starting August 1, 2014. In October 2014, we came to an agreement to lower the child support to 670.00 per month, he paid the arrearages and I signed a quit claim deed to the house we co owned. He stopped paying child support as soon as we signed the agreement, so after two months I went to DCSE. He was quick to put the house into his name in October, 2014, however he never had the agreement we had written up by our lawyers entered into court so DCSE has been only able to use the court order from August. I called and told him about having the agreement signed and entered into court by the judge and even offered to do it for him. Four months later it is still not done. He recently sold the house and had to pay 4000.00 to Dcse (me) for what they showed in arrearages. All so he could make his credit look better to buy another house. Now he is calling me and telling me I have to pay it back right away. I told him he had to go through dcse. He still has not filed the agreement. He said DCSE said they don't refund money and that he could file a civil suit against me to get the money back. DCSE does not show that he has overpaid, they show he is current. Can he sue me? Will they not credit his account once he files the agreement? I tried several times to get him to fix the amount with dcse and he hasn't. What should I do?

I am afraid that there is no simple way to undo what has been done. it would require an agreement of all parties. Your mom and step father would have to agree to terminate their rights and you would have to adopt. If there is mo agreement, there would not appear to be a basis change custody based on the brief post.
