When a criminal case is over and all the exhibits go back to the jury room for deliberation, does the indictment have to be one of the exhibits or does it go in free standing? FLORIDA



Answer

Not sure what you mean by "free standing" but the indictment can go to the jury. It's up to the judge with arguments from both the defense and prosecutor to decide if they see the indictment. Of course an indictment is rarely used except for very serious crimes.
