If he claims you "stole" the snowmobile then his option would be to file criminal charges. The police would have to do some investigating but if he signed the title over to you and advised you this was a gift, I don't think the police are going to do anything and they will tell the family member its a civil matter. The family member can sue you civilly for the loss of the snowmobile. In that case it would be up to you to defend any suits by claiming a gift. I have no idea what would happen - it depends on the quality of your proof versus the family member.

However, you have left a lot out of your post. People just don't give others snowmobiles and then change their mind. Either something happened between you or this was not really a gift and you were to just hold onto it. Or maybe there is some other explanation. Either way, there is a whole lot more to this story. I suggest that you refrain from posting anymore on the internet and have a consult with a local lawyer and acquaint him or her with the full details.

The accident occurred during a green light after waiting at the red light. After much persistence I succeeded in getting the Grievance Committee (in Hauppage, 10th Judicial District) to issue a Letter of Caution to my former attorney. (He never apprised me of the specificity of a $93,000 lien on my settlement and that it would severely impact my settlement check.) I took him to Small Claims Court yesterday thinking this would be my main ammunition and it was objected to and sustained as "not being disclosable" and "confidential". Is this true? The judge would not take it from me and read it, but he did informally ask the attorney what it was about to which he played it down as "not a disciplinary action". Once again I am miffed with the Grievance Committee for not advising me of this and I spent 4 long hours waiting for my case to be called. The judge also seemed to have no clue about the Professional Code of Client Rights which comes right off the Bar Assn website as well as the nycourts.gov website and the merits of that were also shot down.

The Grievance Committee's action is but one angle on your proof of non-disclosure and incompetence against your attorney. Your action is for malpractice, i.e., proof that your case was worth far more than it was settled for and that your attorney's failure to further compromise your lien adversely affected your recovery. This is a very high bar to overcome. Small Claims Court is definitely not the venue to even consider your case, let alone rule on it.

Perhaps the strongest approach would be to assert that a partnership was created between the family company and you, and that you are entitled to withdraw and claim a share of the partnership's valuation under the California Revised Uniform Partnership Act.

Generally speaking, if you are an employee and your job included creating computer code, then the employer owns the copyright on the code and can exploit it as they wish. If you are an independent contractor creating computer code, then you own the copyright and it can only be transferred to the company in writing. If this is a partnership of four people and each of you gets 1/4 of the company profits, then you might be able to enforce that in court.

Especially because you don't already have a written agreement, it would be better for you to make a written agreement with the company as to the terms of your leaving and specify any ongoing royalties you are to receive.

Hmmmm, I'm not sure the previous answer is totally correct. I doubt it's criminal trespass to remain on the property after eviction IF you have the property owner's permission, whether you received the permission directly from the owner or via someone acting in the capacity of an agent for the owner. However, even though you are not a trespasser (in my opinion), neither are you a tenant! You are perhaps a licensee, possibly a guest although the fact that you are paying something lessens this possibility. In either case, I believe you can be asked to leave at ANY time and must do so within a reasonable time thereafter or you'd become a trespasser. IMHO, the landlord does not need to go through an eviction process to remove you this time around. However, until asked to leave, you probably aren't committing criminal trespass.

Mr. Whipple just stated the most flawed hokey theory of agency that I have ever read. Once the principal evicted you with lawful process, you cannot rely on a theory of agency to claim that the agent was acting legitimately on behalf of the principal.

Of course it is criminal trespass, and don't kid yourself. It is a violation of Penal Code sections 419 and 602.

Registering in DE probably did not do you much service practically speaking. That is, if the business activity is taking place in CA then you are required to qualify the entity there (see the following link for a brief overview of foreign entity qualification: http://www.lanternlegal.com/foreign_entity_qualification.php).

Regards to permits or licenses, this all depends on what you are doing exactly and where. You may not need any registration or you may be required to jump through a number of hoops. There must be, but the limits applies only to the filing of charges. It does not limit when the defendant may be arrested, tried, or convicted if the charges were properly filed. You should presume charges were filed before time ran out. Your goddaughter is not remotely out of the woods.

Her best bet is to get a lawyer in Philadelphia, since that's the charges must have been filed in the federal court in that city. The lawyer can then explain her options and offer some guidance.

What kind of car is it? I would go to a dealer who deals in the same model of your car (if its a Toyota, go to a Toyota dealer, if a Chevy, a Chevy dealer and so on). Find out if the dealer knows anything about the dealer who suddenly disappeared. If they know nothing, see if they will honor the deal.

If you have a valid lease then any dealer should be able to accept the car at lease end. They should also be willing to accommodate on oil changes and so forth because they know if they are good to you, you might get your next car from them when your lease is up.

If you cannot get any help, try contacting the Pennsylvania Auto Dealers' Association or the State Board of Vehicle Manufacturers & Dealers. They may have some advice.

In a worst case scenario, you may not get any of the perks (like free oil changes) from a new dealer if the old one has gone out of business. But you should be able to turn the car in to an licensed dealer who sells these vehicles.

This is a serious matter that needs to be addressed as soon as possible. Generally speaking, though following the notice rules and giving proper notice is extremely important courts do not necessarily invalidate other methods of notice. Unfortunately without reviewing the founder agreements, bylaws and the actual circumstances it is impossible to determine your rights and the notice requirements. If the value of your equity or contribution to the startup is important to you, then consider retaining an attorney to help you in the matter.

Generally the review process should only take a few hours and is not costly. At the end of which you will know what your rights are and the course of action you should consider. Unless you are the trustee of the trust in which the property is held, there is nothing you can do to transfer any interest in it. You can disclaim an interest in a trust, which is not a recorded document, but only the trustee can transfer ownership interests, and only consistent with the trust documents. If you are the trustee, then you have a situation that requires a lot more information before anyone could properly advise you on how to transfer interests and what you are legally permitted to transfer to whom under what circumstances. You will need to consult with the attorney who prepared the trust for guidance. To address your base question, however, a deed never has to be recorded to be effective as between any persons who have knowledge of the deed, as long as it is signed, notarized, and delivered to the grantee. If it is not recorded, however, all kinds of problems eventually develop down the line and anyone who does not have notice of the deed is entitled to rely on record title in dealing with the property, meaning as to the wide world the deed would not legally exist.

The "reading of the will" is a Hollywood trope. More often than not in real life (and death) it simply doesn't happen. If the estate plan is a will subject to probate in the courts, then all of the beneficiaries named in the will are entitled to notice of the petition to administer the will in probate, and that notice includes a copy of the will.

However, given the value of the assets, it's far more likely that there is a trust. In California, the trustee must provide a notice to all of the beneficiaries (and certain other persons) within sixty days of the date of death under Probate Code section 16061.7, and that notice also informs the beneficiaries of their right to request a copy of the trust instrument.

This is actually quite a technical question. "Listed exchange" can bear a general meaning and a technical (legal) meaning. On the basis that "listed exchange" generally means, as widely understood in the financial world, a stock exchange which (i) is regulated by market disclosure, insider dealing, entry qualification etc. requirements in common with international standards, (ii) offers sufficient liquidity to attract international investors, then the answer is yes, the Bombay Stock Exchange is a listed exchange.However, "listed exchange" and similar terms bear different meanings in a legal terms. Stating that you were featured in X, when you were is perfectly fine. This falls under the category of nominative fair use. Where you should draw the line is to use "no more than what is necessary" to express that point. That is, you do not need to use any company's logo to make that statement, although it grabs visitor's attention and looks better...I understand.

That said, I would not have a problem doing so because in context this is not the kind of thing that any of these companies are really policing for and no one is going to sue you on account of that kind of use. And we all know there are countless companies doing so and it is not even clear in all federal district courts whether that would even be actionable. You are much more likely to just receive a cease & desist letter and if you do just comply. Further, if you are using logos for this from a number of companies you further mitigate any claims because it is less likely any one company will be able to argue market confusion or false association when they are just one of several logos used.

In sum, potentially actionable, but not realistically so in my opinion.

Frankly, if you do not know what the orders in the case require you are not going to be able to find and understand cases (and this is not the place to get legal research). You either need to hire a lawyer, or go to court on your own and be prepared to show the Judge exactly where an order has been violated.

The simple answer is that: 1) a Judge signed an order requiring him to pay a certain amount beginning on a certain date, 2) he appealed that order, and 3) his appeal was denied, then the Judge's order still stands and is good from the date it was issued until now. He was suspended from the following game as well. Now the league is saying he is suspended for 2 more weeks pending further investigation. He has had a meeting with the little league board and has apologized to his coaches and some teammates. I have apologized for his behavior to all the parents on the team. If he is suspended for 2 more weeks he will miss practices and 4 more games. That is a total of 5 games missed. The season only has 10 more games left. It feels as though he is being bullied into quitting and I am being ostracized as well. I know for sure that 1 parent said if he returns she is pulling her son out, but he made a mistake and has been punished for it. I am not sleeping well and do not need the stress but have always told my son not to quit. This is my son's last year in little league due to his age and he has been in this league for 10 years now. The bullying and ostracizing is the part that is making me sick. Is there a possible civil case so this does not happen to another child?

A boy who gets ejected from a game and then throws a tantrum over it needs 1) to learn a lesson. 2) a counselor WAY more than a lawyer, and 3) parents who realize that getting him out of the penalties for his misconduct is damaging their son's character. Does it not occur to you that YOU being ostracized is because YOUR response to this situation is a problem as well? Do you not realize that the other parents see your son's parents as the root of the problem if they are treating you this way. Does it not occur to you that they may well be right? The law is not going to help you prevent your son from suffering the consequences of his misconduct.
