At that time we were given this letter dated April 29, 2014 and told by the assistant manager that we had 20 minutes to respond to the letter before their office closes. The letter states that the new rental amount will be $925.00 a month for a 1 bed room unit. This amount goes into effect on June 1, 2014.
It also says we have an opion to pay $675.00 (flat rent) or $925.00 (income based) rent. We had to submit in writing our request for either the flat or the income based rate and that this will be effective starting on June 1, 2014 and was given 20 minutes to do so.
So we wrote out a statement selecting the flat rate fee. We were then given a bill from the manager statingeffective rent date May 1, 2014 $188.00 tenant rent plus $675.00 flat rate amount.
Are we to be expected to pay both the 188.00 plus the 675.00 fees by May the 1st, 2014?
Can they even do this as in raising the rent and forcing us to agree to it without having a proper amount of time to review it with an attorney?

Obviously, you Don't want tolive at this place. There are probably a lot of better apartments between$188 and $675. Tell the complex that, since you haven't moved in and they haven't set aside an apartment for you. You should not owe any penalties, and should get all your deposit back. The complex will either honor this or stop trying to charge the extras that they seem to be seeking now. Without reading your rental agreement, it is impossible for anyone here to estimate owe much and when you owe.

The judge has the right to run his / her docket as they see fit - within reason. There can be multiple cases set on the same day; there can be no jurors available; there can be other problems of which you are not aware.
You must file a written demand (through your attorney) for a speedy trial for it to be violated.

There is no such thing as a legal guardian through durable power of attorney, and you don't do this with forms. You do this with a lawyer's help. If you have an actual guardianship, done by the probate court (the only way to do that), you show the bank your court order. If you have a proper POA drafted by a lawyer, you use the POA. And with a proper POA, you could simply log into the bank site and based on the language in your POA, do what you need, so it's apparent you have not gotten the legal help you need from a lawyer.

Why would the executor transfer property into his name? That is not how it works.
Since executor is in jail, then he needs to renounce executorship. If he will not do it voluntarily, then file a petition with the probate court to have him removed and yourself or someone else named as successor. Then complete the estate administration and have the new successor transfer the property into the name of the designated beneficiary.
You will probably need a probate attorney to achieve this. You need a local attorney who practices in the county where the estate is pending.

There is no such law or duty. In theory the discrimination laws are not designed to convey special privileged status and preferential treatment on handicapped people, only to avoid adverse 'discriminatory' treatment or effect. The closest you get is the requirement to provide access accommodation with wide doorways and aisles, ramps, etc. IF the store regularly provides or offers 'to the car' service to all, but refused him, you could argue discrimination motive for the denial. Anyone could argue foreseeability, whether handicapped or not, but would first have to show there was a duty, when there is not unless there was some known but hidden dangerous "condition" in the parking lot access. Carrying items as described placed him in 'assumption of the risk', just as anyone else.

A spouse should file for divorce in the county where the parties last resided together, if a spouse continues to reside there. It depends on the restricted usage tag. Generally if a building is tagged it means it either is unsafe even to enter, or it is unsafe to sleep in and/or occupy. So I'm unclear why you claim the building was tagged but not uninhabitable. Tagged usually means you can't live there or at a minimum can't sleep there. If that is the case, the landlord not only has the right to, he has a duty to kick you out.

My house received damage from shotgun pellets. The mother of the boy that caused the damage said that she is willing to pay for some of the damages and of course doesn't want the case to go to court. I don't really want to take it to court either and I have not filed charges but the deputy (who is friends with the boys father)has asked me several times to sign a decline prosecution form. I don't want to do this until I have something in writing from the mother concerning payment arrangements. Am I doing anything wrong by this?

The deputy is crossing the line into a grey area of potential misconduct especially if he is asking you to do this in his official capacity and not just as a friend of the family. I would recommend that you inform this deputy to back off and mind his business or you will consider reporting his conduct to Sheriff William Schatzman. On last thing, I understand you wanting to give neighbors time to resolve things amicably but don't wait too long these things do have time limits.

Well, the consequences would probably depend upon whether the omission was negligent or intentional; in order for there to be fraud, the perpetrator must have an intent to deceive. As a practical matter, such an omission is not likely to fool a buyer or lender, because loans secured by a deed of trust are ordinarily and routinely recorded, and buyers and new lenders almost always check the official records, either personally or through the title insurer. Nevertheless, there are occasional instances of "do it yourself" real-estate sales and financings in which an amateur participant may fail to check the records, or where something wasn't recorded. If you have knowledge of someone attempting to engage in such activity, whether through personal negligence or an attempt to defraud, the first thing to consider doing is to advise the person, as gently as possible, that you notice they seem to be making a mistake. You could then go to the county recorder and make sure that the loan you suspect is being excluded from mention actually appears as a recorder lien against the property in question. Whether you should finally approach the buyer or new lender that might be deluded by not knowing about this existing loan depends upon your circumstances with respect to the persons involved and the property itself.

Unfortunately, there is no legal requirement that people actually understand the legal documents which they sign. Rather, it is only necessary that they sign them freely, voluntarily and with an opportunity to review them. If they do not bother to review them, or whenever people sign things that they do not understand, they take a horrible risk. Fees and charges in the fine print, which they would not want, are turned into legally enforceable obligations and they become stuck with a lien against their home (due to their notarized signature on a recorded document). Such a first mortgage will often even survive a bankruptcy filing and can only be removed via payment in full, although second mortgages can sometimes be removed in chapter 13 bankruptcy. If your mother was truly the victim of a mortgage scam (of which there are many these days particularly targeting the elderly), she should go to law enforcement and file a criminal complaint. However, I would first recommend that you gather all the closing documents and review them, since it is possible that this is only a line of credit which has not yet been drawn upon. In that event, it would be normal and proper to show the existence of that account on her credit report as a potential debt. If draws were made against the line of credit, it should be very simple for your bank to trace where the money went.

You have two problems with finding anyone to take your case. The first is simple economics. Lawyers can only take cases on contingency, which I assume is what you would need, if there is enough of a pay-out if they win for them to work for free until they do win - AND collect. We have to pay our bills, our staff, our rent and feed our families. So when a win won't even result in a meaningful damages award, we can't take the case unless the client will pay us by the hour as we do the work. In the case you describe, you do not have much in the way of damages that can be compensated in money. In an employment case like this where someone has to quit their job to escape the harassment, and the harassment is ongoing for months or years, and they have to go into therapy to recover, there are real economic damages that a lawyer can be paid from. In your case you only have a single, if very disturbing, event, which will not result in much of a damages award. So unless you want to and are able to personally fund a crusade to make a point, by paying a lawyer each month for his or her time while they proceed with the case, there is no way a lawyer can take the case from an economic standpoint.
The second problem is what the other law firms told you. You don't have any admissible evidence any of this happened except your word. One of the things we lawyers know all too well is that people lie, a lot, for a lot of reasons. And sometimes they don't outright lie, but they exaggerate. That is why we look for more evidence than one person's word against another. In a civil case, the jury does not have to find guilt beyond a reasonable doubt, but they do have to find in favor of the story that is "more likely than not" true. The burden of proving that is on the plaintiff. So if you have two completely opposite stories and no other evidence, the defendant generally wins, unless the jury is convinced the defendant is lying. That is because equally likely does not win. It has to be "more likely than not." So he-said, she-said cases are incredibly hard to win; they are 50/50 at best. That is also why the police are less than excited about the case, since they and the DA would have to prove what happened beyond a reasonable doubt.
And that also goes back to the economics. A lawyer who only gets paid if they win, might take a 50/50 case if the pay-out would be huge, and they have plenty of other cases to support their practice. But taking a 50/50 chance on a he-said, she-said case when their 1/3 or even 40% of the judgment will be a few thousand dollars would be economic stupidity. Even pro bono non-profit legal services groups will not take cases like that, because they have to focus their limited funding on cases that will have a big impact and have a better chance of winning.
So the bottom line is that unless you want to and have the money to pay an attorney an hourly fee for the case, you have little or no chance of finding an attorney to take it. The best you can do is file complaints with the state medical board and any private specialty board he may be certified with, if any.

The mortgage is a lien on real estate. It survives the bankruptcy, no matter what. The discharge of the DEBT doesn't affect it. The mortgage folks have a lien on the property, period.
You will either make peace with them (reaffirm the debt, or make it a part of your Chapter 13 plan) or they will foreclose. They will file a Motion to Lift Stay (which will be granted) and will take their property back. They don't even care that much about the debt being discharged. Bankruptcy affects DEBTS, not purchase-money liens.

However, IF an attorney has falsified a subpoena, and used it to obtain your protected private info, then you could report that to the State Bar in a complaint, and report it to the court shown on the subpoena, and report it to the police as a crime.

Even if she does the cost would most likely be more than the $75. The type of thing you have mentioned is pretty standard although $75 is a little higher than I have seen but it is the price you pay for them to get the toll road evasion letter in the mail, process it to you, etc....given standard charges it only takes an hour or two of work to reach $75. Chalk this up to tuition in the School of Hard Knocks.

You don't need to pay her anything. Your situation is such that no reasonable person would remain in occupancy. This is constructive eviction, and you can sue for it. Sue for return of the security deposit plus expenses of moving and the destruction of your leasehold. She seems to have broken the covenant of quiet enjoyment (which has nothing to do with noise).

Unless the seller was exempt, the seller had to fill out a Seller's Disclosure Statement. Review of that Statement may reveal a misrepresentation.

I was pulled over, my ticket was checked 'Marked' and I showed the officer that there was an AUX cable and that there was music playing.

The reason is that as long as revenues are above variable costs, the firm will earn a difference to contribute to the fixed costs (fixed costs are costs that a company has to pay in the short-run whether it operates or not). If the firm stops operating in the short-run, it will have to pay for the full fixed costs (e.g., rent, some fixed labour)
If revenues are below variable costs, for every unit of production, the company loses the difference and does not contribute to the fixed costs. It is more economical to shutdown in the short-run.

Perceptual Selectivity
Perceptual selection is the process by which people filter out irrelevant or less significant information so that they can deal with the most important matters.
Perceptual Selection is determined by
External Factors

External Factors affecting perceptual selection:
Size: The larger the size, the more likely it is to be perceived. The tallest person in the office will invariably be noticed.
Intensity: The more intense an external factor (bright light, loud noise, high pitch sound etc.) the more likely it is to be perceived. One may notice that the TV commercials always have high pitch as compared to normal telecast.
Contrast: External factors that stand out against the background or things that are not which people expect are more likely to be perceived.
Motion: A moving factor is more likely to be perceived than stationary factor. Films (motion pictures) attract people more than a static picture.
Repetition: A repeated factor is more likely to be noticed. Marketing managers use this principle in trying to get attention of the prospective customers.
Novelty and familiarity: Either novelty or familiarity will can attract attention. People would quickly notice a person riding an elephant on a busy street in Delhi. On the other hand, one is likely to spot a familiar face in a crowd or a familiar voice even if there is a lot of noise and confusion.
A combination of these or similar factor may be operating at any time to affect perception. Along with the internal factors, they determine whether any particular stimulus is more or less likely to be noticed.
Internal factors affecting perceptual selection:
Personality: Personality has an interesting influence on what and how people perceive. For example, conscientious people tend to pay more attention to external environmental cues than does a less conscientious person. Less conscientious persons are impulsive, careless, and irresponsible. They see their environment as hectic and unstable which affects the way they make perceptual selections. On the other hand, more conscientious people organize their perceptions into neat categories, allowing themselves to retrieve data quickly and in an organized manner. In other words, they are careful, methodical, and disciplined in making perceptual selections.
Learning: Learning determines the development of perceptual sets. A perceptual set is an expectation of a particular interpretation based on past experiences with the same or an identical object. In organizational settings, past experiences of the managers and employees influence their perceptions to a great extent.
Motivation: A person's most urgent needs and desires at any particular time can influence perception. People perceive things that promise to help satisfy their needs and that they have found rewarding in the past. Also, according to Pollyanna principle, people process pleasant event more efficiently and accurately than they do unpleasant events. For example, an employee who receives both positive and negative feedback during the appraisal meeting may more easily and clearly remember the positive statements than the negative ones.
Perceptual Organization
Figure-ground: Perceived objects stand out as separable from their general background. In the context of organizations, a company may import a new technology in order to compete in the globalized economy. Here import of a new technology is a figure and global competitive environment is the background. The employees will immediately notice the installation of new technology whereas the global competitive environment is not visible by naked eyes.
Perceptual grouping: There is a general tendency among individuals to group several stimuli together into a recognizable pattern. There are certain underlying uniformities in grouping. When simple constellations of stimuli are presented to people, they tend to group them together by closure, continuity, proximity, and similarity.
Closure: An individual may perceive a whole while one actually does not exists. The person's perceptual process closes the gaps that are unfilled by from sensory inputs. In a formal organization, employees may either see a 'whole' that does not exits or not be able to put the pieces together into a 'whole' that does exists. For example, head of a project team may take the view that the entire team agrees to his plan of action whereas there are differing views among the team members, which remains unarticulated in a formal manner. On the other hand, a functional team might view/perceive that their objectives are the objectives of the whole company.
Continuity: An individual tend to perceive continuous lines/patterns. This leads to inflexible thinking on the part of organizational members (both managers and employees). Thus, only the obvious, continuous patterns or relationships are perceived. For example, a new design for some production process or product may be limited to obvious flows or continuous lines/patterns. New innovative ideas or designs may not be perceived.
Proximity: A group of stimuli that are close together will be perceived as a whole pattern of parts belonging together. For example, several employees in an organization may be identified as a single group because of physical proximity. Several workers who work on a particular process may be viewed as a single whole. If the output is low and the supervisor reports a number of grievances from the group, the management may perceive that all the workers working on that particular process are trouble makers whereas in some of them might be loyal and dedicated employees.
Similarity: The greater the similarity of stimuli, the greater is the tendency to perceive them as a common group. Similarity is conceptually related to proximity but in most cases stronger than proximity. In an organization, all employees who wear blue collars may be perceived as a common group, when in reality, each employee is a unique individual. This might also lead to perceptual error termed as stereotyping.
Perceptual Constancy: There are two issues. While objective reality of stimuli remains unchanged, people's subjective reality also remains constant. That is, the individual is likely to give meaning to stimuli in the same way whenever exposed to them unless and until objective reality has been revealed more broadly by way of undoing the perceptual errors. For example, a manager in the company who believes that female employees are poor performers would continue to have the same perception until and unless the latter prove that they are better than their male colleagues.
Perceptual Context: It gives meaning and value to simple stimuli in the environment. The organizational culture and structure provide the primary context in which workers and managers perceive things. Thus, a verbal order, an e-mail message, a new policy, a suggestion, a raised eyebrow, a pat on the back takes on special meaning and value when placed in the context of work organization.

Similarity error: People are predisposed towards those having similar traits, socio-economic-cultural background.
Contrast error: People tend to compare among the available resources and thus arrive at a conclusion that might be far from the objective reality.
Race/gender/age bias: People's perception may be tempered by their prejudices vis--vis race, gender, and age.
First impression error: People may hold a long-term view about a person or thing based on first impression.
Perceptual defense: People tend to defend the way they perceive things. Once established, a person's way of viewing the world may become highly resistant to change. Sometimes, perceptual defense may have negative consequences. This perceptual error can result in manager's inability to perceive the need to be creative in solving problems. As a result, the individual simply proceeds as in the past even in the face of evidence that business as usual is not accomplishing anything worthwhile.
Stereotyping: It is the belief that all members of a specific groups share similar traits and behaviour. Most often, a person is put into a stereotype because the perceiver knows only the overall category to which the person belongs. However, because each individual is unique, the real traits of the person are generally quite different from those that stereotype would suggest.
Halo effect: Under halo effect, a person is perceived on the basis of a single trait. It generally occurs during performance appraisal where the supervisor rates an employee on the basis of only one trait e.g. intelligence, punctuality, cooperativeness appearance etc.
Projection: It is the tendency of seeing one's own traits in others. Thus, individuals project their own feelings, personality characteristics attitudes, or motives onto others. Projection may be especially strong for undesirable traits that the perceivers possess but fail to recognize in themselves. People whose personality traits include stingyness, obstinacy, and disorderliness tend to rate others higher on these traits than do people who do not have these trail.
