I am almost certain that my spouse recently committed a felony, and it appears that so far at least he is getting away with it. I think no one else even suspects that he committed this crime. Am I required by law to inform law enforcement officials of his actions?



Answer

The answer to that is yes and no. Iowa has no law concerning misprision of felony (which is what we're talking about) but in the federal system misprision of felony is a crime in and of itself, 18 U.S.C. 4. By not disclosing you run the risk of being involved as an accessory, and there are some offenses where by merely being present you have some risk of liability, for instance, when there there may be stolen property, narcotics, or contraband on the premises and you have access to it and knowledge of its existence.
