Question

I live in Michigan and have joint custody of my daughter, she is 16. I have physical but we share legal custody. My daughter can choose whether or not she wants to spend time with her dad every other weekend, but has opted not to. She was recently in an accident and is in a rehabilitation facility. Do I have a legal right to still follow the guidelines of our custody arrangement and grant him access to her only on "his weekends"?

Answer

You're asking whether you have the right to deprive the father of the opportunity to participate, encourage and assist in his daughter's rehabilitation? Really? You gave a 16 year old kid the right to make adult parenting time decisions? Really?
