If you want to end the arrangement, read the contract and see what you need to do to give the other party notice of intent to terminate. Your right to terminate would be absolute and immediate if the other party were in material breach of the contract, by the way.

You have not given away the 20 acres, you are just creating a lein against them in the form of a "mortgage" If you want to transfer only some of the property rather than all, you may be able to do so, but you may have subdivision issues to deal with. You need to see how title is structured, and you need to engage real estate counsel to work through this with you. When you say the home and land will be worth 225,000 does this include all 20 acres? Or is this the home and a small portion of the property on which it is located? If the total value of 20 acres and the home is only 225,000, and you are now in debt 80,000, does it make economic sense to incur the construction costs and risks of building? That is a pretty cheap house. Obviously only you can deternine the economic desirability of your plan, but it does raise questions. Please clarify your inquiry.

The time spent in prison is excluded from the 10 year period. So the 10 year period runs from when he was released fom jail. Even adding 5 years to 1997 brings your friend to 2002, which would not make him a predicate for a 2013 arrest unless there is other jail time. The statute specifically states that time spent incarcerated is exluded.... so parole time does not count. See Penal Law section 70.06(1)(v).

This argument has changed thru time as tax and accounting law has evolved. In the past, if you purchased an expensive piece of equipment like a computer (which used to cost about $10k in 1982) and paid for it outright, you had to use standard depreciation tables and could only take a portion of the value each year as a deduction. It might take you 10 years to finally write off that computer even though you through it away 7 years before. This was because a computer at the time cost about as much as a pick up truck and the IRS depreciated many expensive items the same way regardless of their "real" lifespan. (Computer equipment becomes obsolete in a short amount of time lets say compared to a bulldozer or industrial compressor which could last for 20 years or more.)
Leases solved that problem for many companies. Because a lease in really only a long term rental agreement (with a cheap buyout), businesses wrote off every payment as they were made. They didn't have to wait for 10 years or more. They also didn't have to take an accounting hit as the lease was cloaked as "epquipment rental" and there was no visable long term liability. This created a huge tax and accouting incentive to lease over buy.
When FASB accounting principals changed a few years ago, leases of computers, car and other expensve items now had to be "capitalized", and the company had to show on their balance sheets a corresponding liability for each lease. This made leasing not as attractive for some businesses already saddled with lots of debt on their books.
Regardless of buy or lease, unless there is a substantial (say 40% or more) residual value, it really doesn't matter. Just be warned that many small item leases have buried interest rates (they call them "factors") of 20% APR or more. So buy it if you want to save money and don't pay an outrageous interest rate just to say you "leased it". The hidden lease charges will usually more than offset any tax advantage.
A lease option is preferable for the following reasons: 1. You are not saddled with obsolescence (typical of a high tech item). You can return the item / upgrade without much trouble (depending on the type of lease). 2. Usually high tech items depreciate very fast - hence if you plan to use the computer eqpt for a short period of time, it is a good idea to lease it.

However, I have seen clients get charged where the property was close to a business but close to a dumpster and that was not considered abandoned. Debt Collection (Missouri) -- in June 2012 I moved residences and neglected to inform the electric company of a forwarding address. Long story short I was frustrated to find a delinguency in the amount of $343 had shown up on a copy of a credit report that a landlord at a (third) new residence had ordered prior to my moving into a new apt in Mar 2013. I payed the electric company (the original creditor) in full on Apr 14, 2013 unaware that a collections agency was also involved in this matter. Fast forward to present day, I have recently obtained a hard copy of my credit score with a collections agency claiming a delinquency in the amount of $18 for the very same bill and showing non-payment of said amount as of Nov 2012. I never, not once, received any correspondence or communication from the collection agency in regard to the debt in question. I am confused as to how the collections agency can have a stake in this claim, or converesely, if the debt was sold to the collections agency, whether or not the electric company had a legal claim to the aforementioned debt and broke any laws by accepting payment from me. I am not sure whether to dispute the $18 or simply pay it and be done with the matter. I would also like to know where this $18 came from in the first place, are collections agencies legally allowed to charge interest or service fees on accounts receivable that they have purchased??

Based upon the facts you described, you might have a viable claim against the collection agency, for taking action without sending you notification. You would consult with a civil practice attorney about pursuing the action against the collector. You might try to find one that handles bad collection cases. It might be that they sent a letter to the address that the electric company had for you. In that case, there may not have been a violation of any credit collection or other consumer protection laws. But, you will probably need to get an attorney to find out.
You may owe the money. Many utilities include clauses in their service agreement that say the consumer is responsible for the utility's costs of collecting past due bills. Collection agency costs can be part of that, in some cases. The timing of when you paid the utility compared with when the letter was sent to you, or the collection agency was employed, may be what determines whether you owe the $18. The acceptance of the principal (amount of unpaid electricity bill) may have negated your obligation to pay collection costs. You could spend thousands of dollars to litigate this issue. The dog owner is strictly responsible for injuries caused by her dog under California Civil Code section 3342. You can take her to small claims court if you want to, or even hire an attorney for a personal injury case in the Superior Court if her injuries are that severe.

I just started renting a house in Glendale from a property management company. When I looked at the house the pool was in bad shape, it was a pond and the pool equipment was not working. The realtor that I was working with asked if the pool would be in working order and ready to be used when I moved in, the rental company assured him that it would be and that they needed 10 days to make all the necessary repairs (pool needed to be drain, acid washed, broken drains fixed, and the pool light needed to be fixed as well.) When I signed the lease and pick up my keys I asked again if the pool was ready, because I was not going to sign the lease and give the deposit if it was not, the assured me that everything had been repaired. I move from another state only to find out that NOTHING had been done to the pool and I still had an unusable pond in my backyard. The lease states that the landlord is responsible for the pool maintenance and chemicals. It has now been a month and while I can go in the pool, the pool will only filter through the spa, the self cleaning vents in the pool don't work and neither does the pool light, they are also refusing to reimburse me for the water that it took to refill the pool that should be their responsibility since it was supposed to be done BEFORE I moved in. It seems in AZ I don't really have alot of rights as a tenant and this company is exploiting that. Please let me know what I can do it get this resolved as soon as possible and enjoy my new house! Had I been your bankruptcy attorney I might have told you to abandon the timeshare because what it costs you to maintain your membership is much higher than the extra money it would cost to get you a comparable hotel vacation.
That being said. . . . you can't make anyone change a contract which you have already entered into. The terms are laid out and both sides have the right to enforce the agreement. Rights in a contract can be modified in bankruptcy. Without seeing your bankruptcy petition and how it was listed on the bankruptcy you may or may not have preserved your rights under the time share contract. If they were properly preserved, then they can ask for money going forward and must give you your points with the past debt forgiven. It may be a violation of the automatic stay for them to not honor the contract now without you paying the old debt, if this is what is happening.
Go back to your bankruptcy attorney to ask for help with determining whether you protected the time share or not by listing it on your bankruptcy, not just as a debt but on Schedule G as an Executory Contract which you wish to continue fullfilling.

Prior support is suppose to be for a previous marriage or CS for children from a prior relationship. He had NO prior support order because he had NO prior relationship. Anyway, I want to run the numbers again to see if additional child support SHOULD HAVE been ordered. But I can't find the old guidelines anywhere. Can you help? Thanks SO much.

You need to find a copy of the Iowa Rules of Court before 2004. I would suggest that you contact the Drake or U Iowa law school libraries or the state Law Library at the capitol. These guidelines must be periodically revised and the ones you are looking for were instituted in 2000 and changed in November 2004.

You should have read the agreement before you signed it. You can still point out the mistake to the attorney and ask him to provide you a corrected agreement. Since all he did was a plea with the court and you are paying in installments he probably will do so.
To get a court a appointed attorney you need to be indigent, meaning you can't afford to hire an attorney. Even if you qualified for a court appointed attorney, you have no control over who the court appoints. You get the best or the worst lawyer available. If you got probation, chances are you would have been charged for fee that the county paid your attorney.
If you hire your own lawyer, you can try to find the best lawyer you can afford. You can negotiate the best payment contract you can.
Every lawyer representing a client in a criminal matter, knows that the client has absolute control over whether or not to try the case. Unless he wants to work for free, he needs to charge enough to cover that possibility. It is hard to know what the costs will be without knowing all the facts of the case.
