Straight commission jobs are usually sales positions where a person get a percentage of each sale they make and the percentage can go up the more sales are made. In my case, for instance, I am a business owner and the only employee. I first factor in the base dollar amount my business needs to pay the rent, utilities, etc and then I pay myself a percentage (a high percentage in my case since I'm the owner and the only one here) on all the sales/business above and beyond that amount.

area. We were on vacation visiting family. We departed the next day on our way back to our home in AL. We were pulling onto the interstate in the town of Monticello, FL when a state trooper pulled me over. My husband was in our car and he pulled in behind the trooper. After a little fumbling to locate the title and bill of sale, I passed it on to the officer along with my license. He then wrote me a ticket for an expired license (my fault), and for driving without a tag. I pulled back on the interstate and met my in laws (we were all traveling together) and husband at a service station off the next exit. I showed my husband the tickets and he said I should not have received one for the tag because we were in the "grace period" for purchasing a car. He then started to look for the dated bill of sale showing the date of purchase and we realized it wasn't returned to me by the officer. What do we do now? I have 30 days according to the ticket to dispute this or pay the fine, but I don't have the proof that I was not in the wrong (on that particular citation). I also am having an incredibly hard time getting ahold of anyone at the Florida Highway Patrols office. Thank you in advance.

You should get an attorney that handles tickets there (probably one from Tallahassee) to go to court for you and fight it. The officer may have the bill of sale with him in court or your attorney could subpoena him to bring it (although that can get a little complicated for traffic court). Further, even if he doesn't have it, he should testify about it. Explain the whole situation to your attorney. Your only other option is to come back to court and fight the Monticello ticket yourself (which I don't advise).

You could have worded this question better. I'll give it a shot though. It is impossible to consider all the possible outcomes and probabilities. We can make a best guess based on the information that is available and based on the information we choose to consider and what information we choose to ignore. All the planning in the world does not bring into account unforeseen circumstance. For instance, I could make deal with someone whom I have totally vetted, checked him out, he's honest and a straight shooter, he can deliver what he says he can deliver, contracts are signed, we are ready to do business and he could get hit by a bus on the way home from our meeting.

First, kids say this all the time. So make sure that he is serious. Why does he not want to go back to his grandfather's home?

Second, you would need to go to court and ask the court to give you custody. You would need an attorney to assist you Since the child is 16 the court might consider his feelings.

Third, talk to your son about what he is feeling and what is going on. It sounds like something is upsetting him. It could be at school and not at home. Talk to your son.

Get details. He might need to go into counseling. He might be sick & need to go see a physician. You never know what is going on with a 16 year old.

Fourth, let your son know that if he comes to live with you there will be rules. He might think that coming to live with you would be "fun". Let him know that it won't be "fun". He will have go attend school, make good grades, do chores and behave. It won't be a vacation. He might decide that he does not want to live with you if you are "mean" and "strict" -- right now you are the "fun" person!

State of Kansas: what would be advised for me to do if my daughter's father is facing rape charges for sexually assulting his wife with weapons? She is having to go through surgeries, they are investigating, and she has filed charges. She contacted me stating he has an alcohol and drug problem, he never cares for her when she visits, the wife only did. He has every other weekend visitations, set in court. He doesn't exercise his rights, his mom (the paternal grandmother) picks up my daughter, drops her off, provides for her and literally forces the father to take my child, every now and then. His now ex wife feels he shouldn't be alone with my daughter because of his abuse (physical and sexual) towards the ex and his alcohol and substance abuse. Can I do anything? What is the right thing to do? I have no idea how to proceed and I haven't gotten a return call from my lawyer yet. Also I am getting married in 4 months and my fiance wants to adopt my daughter who is 11. He asked her if she would want that, gave her all the time she needed without any pressure and she said that she does in fact want to be adopted. But she wants to take my maiden name. How do we proceed? Is there legally a way to kep her from his behavior until I know what is happening? Two previous girlfriends of 2-4 years are also willing to say how he treated them and how he neglects my daughter or doesn't exercise his parental rights even if she is in his own home. I haven't spoken with him in years since his mother calls me for visits so I have not witnessed any of this except during his and my relationship through my daughters first 2-3 years of life and he did nothing then, he would literally not feed her while I was at work and just sleep the entire time. I also asked for the medical records and the hospital failed to give them to me for several months. I was told, that they got lost. I had to fly back to the use, in order to get them a year later.

End of 2003 i received an invoice of 18 000 Dollar (!!) and i wrote them back, that i would question the amount and the service for it. I told them to get back to my insurance. In 2004 i had a letter from a collection company and i wrote again back, that i paid and the other amount i questioned it. I did not hear from them until 2012 when i got a letter from a collection company from Europe now. The amount is now much less and every time they write to me this amount various (gets less).Under german law the limitation of service for medical bills are 3 years, i guess in Florida there is a limitation as well, 4 or 5 years depending if its seen as a written contract or oral, right?

After the company did not get any reaction from my side, they wrote me yesterday, that the limitation of service stops if you leave the State of Florida but i was never a resident of Florida and i gave the hospital my proper address in Germany.What is the statute of limitation is this case, it has been now 10,5 years. My biggest concern is, that the limitation of service stopped when i left Florida, is this correct? Would they still have a chance to sue me in Florida? They would need to have a title anyway but i guess this title would be useless to enforce in Germany as it is expired here. But is it expired in Florida? Would i have problems to enter the state?

I wonder, why they never sued me, if its not expired in Florida.

I was transferred to another location and put in the housekeeping dept. The doctor that the company sent me to told me that the company had to keep my pay the same as when I was injured when I returned to work. About a month after I started working in housekeeping my pay was lowered to $9/hr. When I asked why I was told the doctor didn't state that a job change was necessary. That is not accurate and I have documents stating that a job change was necessary. That's why I was transferred in the first place. Last week, the manager at the hotel gave us each a notice of Change of Employer. The hotel recently filed a registration statement with the Securities & Exchange Commission for an initial public offering and the new Employer expects to purchase all of the assets of our Company. I've been waiting until I leave the hotel before i file a wage claim with the Dept. of Industrial Relations for the change in my wages. Can I still file a wage claim if the hotel assets have been purchased by another LLC?

We found out through an upstairs unit's leak that there has been a drywall nail that has been punctured into a vertical kitchen drainline, serving a four unit "stack" since the place has been built in 1984. This has been causing moisture behind the drywall. There is also mold behind our kitchen cabinets on another wall directly underneath the upstairs leak.

The job will be huge, and the Association is backing out of paying by saying that we remodeled the kitchen, and therefore responsible. We have not remodeled, and there are no permits recorded by previous owners. What are our options? Thank you.

The main question is whether the area in question is to be insured and maintained by you or by the association in accordance with the governing association bylaws and covenants. You don't ask a debt collection question. You have 2 issues: (1) lapse of your insurance; and (2) liability for damages that you caused in the accident.

You can reinstate your insurance. However, your insurer is not going to be responsible to insure you for any damages caused by the accident because the policy was not in effect when the accident occurred. Which means that you generally are going to be liable for the damages to the other person if you were at fault in causing the accident.

Even if the other person went under his/her own insurance, the insurer for that person may be seeking reimbursement from the accident from you.

The person who called you is a debt collector and collecting on an insurance claim is no different than collecting on any other kind of debt. Debt collectors lie or shade the truth frequently. If the damages are indeed owed by you and if there is a judgment against you that goes unpaid, your license can be suspended. Your registration would only be revoked of there is some other violation.

First, deal with debt collectors only in writing, not on the phone. If you must talk to them, thjen you need to control the conversation, not them. Do not rely on the debt collector to advise you of your legal rights or listen to their parade of horribles about what can happen because they are not lawyers and wherever they are located may or may not be PA and the laws of each state differ.

Ask them if they have sent you any writing about the debt. If not, give them your home address and have them send it to your home. Tell them you will review and get back to them. Then hang up. Note who you spoke to and the date and time. Also in the conversation ask the collector if the call is recorded. It is; you also might want to ask them if you can record and make a recording. This will unnerve them! And help you establish control.

When the letter arrives see what it says. You may need to speak to an auto accident attorney about this. If the letter advises you that they are trying to collect for damages, this makes no sense about the estimate. Usually the work is done and the insurer sends a check to the affected person or body shop for the amount. Estimates are just that - estimates. They could go up or down.

Depending on what you find out after talking to the attorney and getting the letter, if the letter is just a typical debt collection letter, you have 30 days to dispute the debt and ask for proof of the debt - which would be the damage claim. Once you get the proof then you do need to pay this because if they sue you and recover a judgment your license will be suspended until the judgment is satisfied. And there is going to be court costs.

You have indicated that you were in the accident but you have not indicated if you were at fault - I am assuming in my answer that you would be. However, you should not be posting anymore about this here. That is why you need to speak to an auto accident attorney - perhaps you have defenses or claims to the accident based on what happened. If you do then the attorney should be responding to the debt collector and explaining why the debt is disputed based on the facts.

You don't have to endure this. This is child abuse. Your father needs help...but you and your brother need to be rescued.

You should call CPS. Call your best nearby relative on the same day you contact CPS and make sure CPS knows of the relative. If CPS removes you from the home, you will be placed with the relative, as long as they can drug test clean, etc. If you don't have a good relative nearby, think of the very best adult friend you know of who would be willing to take you in for a while...perhaps a long while...if CPS removes you.

I am so sorry that you are having to put up with this horrible treatment. It's not creepy...it's criminal.

There is a 6 year old little girl that is involved in this case. She has not seen her father(my husband) in about 3 years and now he has decided that he wants to get her every other weekend. Being that he has not seen her in several years, I feel like there should be a reintroduction period for a month. However, my divorce attorney keeps telling me that I am not right and that a judge will not care about the situation...

My questions are:

Am I wrong to want a reintroduction period before she is to start overnights with her father?

Do I have the right to tell my attorney that I do not agree with anything she is saying?

Do I have the right to tell my attorney that she is working for ME and that I do not feel that she even cares?

If the father hasn't had any visitation for over a year, let alone 3 years, common sense should require at least a one month reintroduction period. Your attorney works for you. If your attorney is not working in your best interest, then fire him/her. Before taking such a step, it would be prudent to consult with another experienced family law attorney, and have a substitute attorney ready to assume representation. The only reason that comes to mind that there would be no significant reintroduction period is if you had a history of attempting to keep the father from the child. Even then, as it would be in the child's best interest, a reintroduction period would be appropriate.

My name is David. My girlfriend and I have a 21 month old daughter and are living in a trailer with a year lease agreement. She and I are both on the lease, and we are wishing to get out of it and in the mean time place rent in escrow, and file for rent abatement due to the state of repair being unreasonable to live in. we moved in this October, and have made all rent payments on time. when we moved in there was not batteries in our smoke alarms and no carbon monoxide detector present. The gas range stove was not functioning, and we found out this was due to the gas not being turned on. when the gas was turned on there was a strong gas smell that was report by myself to the owner of the trailer community, and the the on site management. we were told it would be a week before maintenance could take a look at it and thus, I contacted the gas company to escalate the issue. The emergency inspector deemed it dangerous and shut off the gas main which forced a next day repair from the onsite manager. non licensed in gas repair. after the "repair" was finished I had the gas company out again to ensure that the problem was rectified. however the gas range now stood 10" away from the wall. It was only this last week of before Christmas that this hack job was finally addressed. and only done so in pushing and forcing the gas pipe under pressure against the wall. I told the onsite manager this was not a fix at all and that it is dangerous to force gas pipes and that it would have to be fixed right! this is still not resolved to date. When Raquel and I moved in there were eight missing storm windows in the trailer. we brought this to the landlord's, property manager, and onsite managers attention in October. We were told theat the on site manager hadn't even placed an order for the replacements of the missing storm windows until November by the landlord. We still to date do not have the storm windows and have to maintain the thermostat setting at 80 degrees in order to have an internal home temperature of 72 degrees. We have lost power in the kitchen, for the dryer, and several other outlets throughout the house three days ago, and are told we must make the first $75 dollars towards the repair, and yesterday Christmas Eve lost all water to our home and have yet to have a solution from the onsite manager for this. My question is do we have a case and how should we proceed. we no longer wish to live in such conditions and and especially with our daughter?

A meltdown is probably about the most catastrophic failure of the core of a nuclear reactor that can be experienced. We need to review some things about the reactor core so we can get where we need to go with this. But you asked, so pull up a chair and let's get to it.

A lot of the reactors we see are pressurized water reactors, and that's what we'll talk about here. Water under pressure is the primary coolant. At the "heart" of the beast is the core, and we know that the core of a nuclear reactor is where the nuclear fuel, the fissionable material, is located. An actual fuel element is usually either a long tube or a long, flat plate. In the tube-type, a special alloy steel tube is filled with fuel pellets (little cylinders that slide down into the tube) and has caps welded on both ends. In the plate-type, a long ribbon of fuel is encased or "sandwiched" between plates of that specially alloyed steel, and it's welded along the sides and across the ends to completely seal in the fuel. In either case, the fuel is sealed up inside a steel casing (which we call cladding) and it is designed to stay there. The fuel bundles are made up by welding together a number of fuel elements, but with a little spacing between them for coolant. By welding together a number of fuel bundles, we now have a reactor core.

We stick the whole thing in a big pressure vessel with the control rods and all the supporting paraphernalia. And run the thing hot; 500oF isn't uncommon. The water stays liquid at these temperatures because we pressurize the primary system. The heat is transferred out of the heart of the fuel elements (where the fissions are happening) into and through the cladding, and into the primary coolant - (usually) water. The heat is transferred out of the water (our primary coolant) into water that is in the steam generators, and this makes steam. The cooler water (still super hot - well over 450oF) goes back into the reactor to suck up more heat. The temperature at the centerline of the fuel elements can run in the 1500oF range. That's hot.

What happens if a gross failure of our primary piping befalls us? Wooosh! Water blasts out and turns immediately to steam. We shut the reactor down immediately, but our troubles have only begun. The pressure that kept the primary coolant in a liquid state is disappearing. The primary coolant begins to boil while the pressure falls through the floor. Look at the surfaces of the fuel elements where the primary coolant comes in contact with them. The now-underpressurized water is turning into steam there. Steam is a lousy conductor of heat compared to water. The fuel elements cannot transfer heat out of themselves into the steam. A little jump here.

When fuel fissions in the core, the fuel atoms "break" into a pair of smaller atomic nuclei which we call fission fragments. A ton of energy is released, and much of it is heat. Those fragments that were created are almost invariably radioactive, and they continue to decay and release heat doing it. This is what we call decay heat, and just because we shut down doesn't mean the core stops generating heat. It will continue to generate huge amounts of heat after shutdown, and for an extended period. There won't be as much of this decay heat as was generated by fission during operation, but it's still lots and lots and lots of heat. And now we have lost the effectiveness of our primary coolant.

At this point, the emergency cooling (XC or EC) system should kick in. It dumps cold ("room temperature") water directly into the reactor vessel to cool the core. It's supposed to work. But it must pump in lots of cool water continuously over a long period. Also, remember that the reactor vessel and the fuel elements are extremely hot. And they have a huge, huge "heat capacity" that the XC system is trying to overcome. The water from the XC system will be turning to steam from almost the moment it enters the vessel and hits the core. The centerline temperatures in the fuel are climbing. XC is not effective (for some reason). Soon, the centerline temperatures of the fuel cause the metals to begin to liquify. Things get worse. Heat is still being generated. More melting occurs. The cladding melts. The fuel in now exposed to the steam in the core. Highly radioactive materials are carried out of the hole in the primary plumbing and into the area inside the emergency containment structure (the "dome" of concrete built over the reactor building). Back to the core.

Molten fuel and fuel byproducts, the latter being incredibly radioactive, begin running down inside the core, and a puddle of this stuff forms at the bottom of the reactor vessel. This puddle is still generating a tremendous quantity of heat. The core has melted down. We've had a reactor meltdown. Should the magnitude of the failure be over the top (like this isn't bad enough), the puddle will melt its way through the bottom of the pressure vessel, through the bottom of the concrete floor of the reactor facility, and into the earth. Not all the way to China, but that's where it's headed - hence the name "China syndrome" from the book and movie. It's possible. We engineer to avoid it, but it can happen. Not a good thing. Not a good thing at all.

I was served court papers from Probate Court as an Emergent Action claiming Irreparable Harm if contract closing date was not met by seller, my sibling Executrix. The contract was contingent on property being vacant at time of closing. I only had 2 business days to Answer complaint, so I asked Court for an adjournment. The original Hearing date was set for the 12th Dec, and contracted closing date was 16th Dec.

A time of Essence letter was sent to Estate Attorney from the buyer's attorney claiming irrevocable harm, and if cannot close contract would be voided or seller would be sued for not performance. Copy of contract was not included in court papers. I have read posts that Time of Essence letter cannot overcome contingencies in a contract and contingencies must be satisfied before it can be sent. I am an heir-beneficiary who has occupied property for decades, and have offered to purchase the 2 siblings shares. My belief is that I am co-owner or tenant-in-common, as the Will states property given to children "in equal parts" and does not state to sell, and I have a right to occupy property. I believe I can claim Irreparable Harm if I am ordered to vacate.

You can file a "Answer" and deny the Petition. It merely serves to notify the court that you are interested in the lawsuit and not to proceed without notice to you. He does owe some back child support in addition to current child support which the Army automatically deducts from his base pay (to cover both the back and current payments). This automatic deduction equates to nearly half of his base pay.

I earn significantly more than my husband does (almost double his salary). Can his ex take us to court to try to obtain more support based on my higher income? It doesn't work that way. Your income is used in support calculations only for how it impacts taxes, deductions, etc. Only his income is used for the actual support calculations. So if his withholding or the taxes owed on his income go up or down bases on being married to you, the support could go up or down a bit, but it will not go up just because he now has a household income that includes yours.

When they took everyone to the party it turned out that the party had been set up in a building they weren't suppose to be in. Talking to your son is part of the investigation. They should do as full an investigation as possible but they don't always to that. Before your son does anything else he needs to get an attorney, especially before talking to the state or police.
