What happens in Florida if you are a first time offender nothing on your record and you sold a beer at a bar to a minor by mistake and now have court coming up?



Answer

If you have no prior convictions, the State won't get that worked up over this charge. Your options will be to either: negotiate a plea deal with the State; if you don't like the State's offer to plea, you can plead straight up to the Judge; or you may want to fight the charge by ascertaining if there is a possible motion to keep certain evidence out (due to an improper search, entrapment or some other improper behavior if it exists, by the officer). Even if you can't win on a Motion, you may still want a trial and see if you can beat it.

I don't know the facts, thus can't advise on your chances of winning at trial or via a Motion, but in my experience, you should be able to get a favorable negotiated plea disposition.
