This is called as an account payee cheque which can be only deposited into a bank account. Such a cheque cannot be cashed for money directly. Hence you can keep a track of who is getting your money. He would need to have a bank account with the name as mentioned in the cheque and hence it is much safer.

Write the advantages and limitations of job Evalution method?
ob Evaluation Methods
There are three basic methods of job evaluation: (1) ranking, (2) classification, (3) factor comparison. While many variations of these methods exist in practice, the three basic approaches are described here.
Ranking Method
Perhaps the simplest method of job evaluation is the ranking method. According to this method, jobs are arranged from highest to lowest, in order of their value or merit to the organization. Jobs also can be arranged according to the relative difficulty in performing them. The jobs are examined as a whole rather than on the basis of important factors in the job; and the job at the top of the list has the highest value and obviously the job at the bottom of the list will have the lowest value.
Jobs are usually ranked in each department and then the department rankings are combined to develop an organizational ranking. The following table is a hypothetical illustration of ranking of jobs.
Table: Array of Jobs according to the Ranking Method
Rank Monthly salaries
1. Accountant Rs 3,000
2. Accounts clerk Rs 1,800
3. Purchase assistant Rs 1,700
4. Machine-operator Rs 1,400
5. Typist Rs 900
6. Office boy Rs 600
The variation in payment of salaries depends on the variation of the nature of the job performed by the employees. The ranking method is simple to understand and practice and it is best suited for a small organization. Its simplicity, however, works to its disadvantage in big organizations because rankings are difficult to develop in a large, complex organization. Moreover, this kind of ranking is highly subjective in nature and may offend many employees. Therefore, a more scientific and fruitful way of job evaluation is called for.
Classification Method
According to this method, a predetermined number of job groups or job classes are established and jobs are assigned to these classifications. This method places groups of jobs into job classes or job grades. Separate classes may include office, clerical, managerial, personnel, etc. Following is a brief description of such a classification in an office.
(a) Class I - Executives: Further classification under this category may be Office manager, Deputy office manager, Office superintendent, Departmental supervisor, etc.
(b) Class II - Skilled workers: Under this category may come the Purchasing assistant, Cashier, Receipts clerk, etc.
(c) Class III - Semiskilled workers: Under this category may come Stenotypists, Machine-operators, Switchboard operators, etc.
(d) Class IV - Semiskilled workers: This category comprises Daftaris, File clerks, Office boys, etc.
The job classification method is less subjective when compared to the earlier ranking method. The system is very easy to understand and acceptable to almost all employees without hesitation. One strong point in favor of the method is that it takes into account all the factors that a job comprises. This system can be effectively used for a variety of jobs.
The weaknesses of the job classification method are:
* Even when the requirements of different jobs differ, they may be combined into a single category, depending on the status a job carries.
* It is difficult to write all-inclusive descriptions of a grade.
* The method oversimplifies sharp differences between different jobs and different grades.
* When individual job descriptions and grade descriptions do not match well, the evaluators have the tendency to classify the job using their subjective judgments.
Factor Comparison Method
A more systematic and scientific method of job evaluation is the factor comparison method. Though it is the most complex method of all, it is consistent and appreciable. Under this method, instead of ranking complete jobs, each job is ranked according to a series of factors. These factors include mental effort, physical effort, skill needed, supervisory responsibility, working conditions and other relevant factors (for instance, know-how, problem solving abilities, accountability, etc.). Pay will be assigned in this method by comparing the weights of the factors required for each job, i.e., the present wages paid for key jobs may be divided among the factors weighed by importance (the most important factor, for instance, mental effort, receives the highest weight). In other words, wages are assigned to the job in comparison to its ranking on each job factor.
The steps involved in factor comparison method may be briefly stated thus:
* Select key jobs (say 15 to 20), representing wage/salary levels across the organization. The selected jobs must represent as many departments as possible.
* Find the factors in terms of which the jobs are evaluated (such as skill, mental effort, responsibility, physical effort, working conditions, etc.).
* Rank the selected jobs under each factor (by each and every member of the job evaluation committee) independently.
* Assign money value to each factor and determine the wage rates for each key job.
* The wage rate for a job is apportioned along the identified factors.
* All other jobs are compared with the list of key jobs and wage rates are determined.
An example of how the factor comparison method works is given below:
Table: Merits and Demerits of Factor Comparison Method
Merits
Demerits
* Analytical and objective.
* Reliable and valid as each job is compared with all other jobs in terms of key factors.
* Money values are assigned in a fair way based on an agreed rank order fixed by the job evaluation committee.
* Flexible as there is no upper limitation on the rating of a factor.
* Difficult to understand, explain and operate.
* Its use of the same criteria to assess all jobs is questionable as jobs differ across and within organizations.
* Time consuming and costly.
Point method
This method is widely used currently. Here, jobs are expressed in terms of key factors. Points are assigned to each factor after prioritizing each factor in the order of importance. The points are summed up to determine the wage rate for the job. Jobs with similar point totals are placed in similar pay grades. The procedure involved may be explained thus:
(a) Select key jobs. Identify the factors common to all the identified jobs such as skill, effort, responsibility, etc.
(b) Divide each major factor into a number of sub factors. Each sub factor is defined and expressed clearly in the order of importance, preferably along a scale.
The most frequent factors employed in point systems are:
I. Skill (key factor): Education and training required, Breadth/depth of experience required, Social skills required, Problem-solving skills, Degree of discretion/use of judgment, Creative thinking;
II. Responsibility/Accountability: Breadth of responsibility, Specialized responsibility, Complexity of the work, Degree of freedom to act, Number and nature of subordinate staff, Extent of accountability for equipment/plant, Extent of accountability for product/materials;
III. Effort: Mental demands of a job, Physical demands of a job, Degree of potential stress.
The educational requirements (sub factor) under the skill (key factor) may be expressed thus in the order of importance.
Degree Define
1. Able to carry out simple calculations; High School educated
2. Does all the clerical operations; computer literate; graduate
3 Handles mail, develops contacts, takes initiative and does work independently; post graduate
Assign point values to degrees after fixing a relative value for each key factor.
Table: Point Values to Factors along a Scale
Point values for Degrees Total
Factor 1 2 3 4 5
Skill 10 20 30 40 50 150
Physical effort 8 16 24 32 40 120
Mental effort 5 10 15 20 25 75
Responsibility 7 14 21 28 35 105
Working conditions 6 12 18 24 30 90
Maximum total points of all factors depending on their importance to job = 540
(Bank Officer)
4 Find the maximum number of points assigned to each job (after adding up the point values of all sub-factors of such a job). This would help in finding the relative worth of a job. For instance, the maximum points assigned to an officer's job in a bank come to 540. The manager's job, after adding up key factors + sub factors' points, may be getting a point value of, say 650 from the job evaluation committee. This job is now priced at a higher level.
5 Once the worth of a job in terms of total points is expressed, the points are converted into money values keeping in view the hourly/daily wage rates. A wage survey, usually, is undertaken to collect wage rates of certain key jobs in the organization. Let's explain this:
Table: Conversion of Job Grade Points into Money Value
Point range Daily wage rate (Rs) Job grades of key bank officials
500-600 300-400 1 Officer
600-700 400-500 2 Accountant
700-800 500-600 3 Manager I Scale
800-900 600-700 4 Manager II Scale
900-1,000 700-800 5 Manager III Scale
Merits and Demerits
The point method is a superior and widely used method of evaluating jobs. It forces raters to look into all keys factors and sub-factors of a job. Point values are assigned to all factors in a systematic way, eliminating bias at every stage. It is reliable because raters using similar criteria would get more or less similar answers. "The methodology underlying the approach contributes to a minimum of rating error" (Robbins, p.361). It accounts for differences in wage rates for various jobs on the strength of job factors. Jobs may change over time, but the rating scales established under the point method remain unaffected.
On the negative side, the point method is complex. Preparing a manual for various jobs, fixing values for key and sub-factors, establishing wage rates for different grades, etc., is a time consuming process. According to Decenzo and Robbins, "the key criteria must be carefully and clearly identified, degrees of factors have to be agreed upon in terms that mean the same to all rates, the weight of each criterion has to be established and point values must be assigned to degrees". This may be too taxing, especially while evaluating managerial jobs where the nature of work (varied, complex, novel) is such that it cannot be expressed in quantifiable numbers.

What is the going rate for roofering jobs in Texas One roofer want 50 per square 3 bundles of shingles a square?
It really depends on the style, height, and pitch of the roof. A traditional shingled gable roof with a relatively low pitch may cost about $2-5 per square foot (yes there are 3 bundles in a square, so a 3000 square foot surface area roof will take approximately 30 squares, or 90 bundles). For a recent job I did in the DFW area, the homeowner's insurance paid about $2 per square foot (or $50 per square)... low pitch & simple roof-lines.If the roof is steep (which should be less common in Texas since it does not snow often, but I think homeowners find the steep pitch visually appealing), has more hips, ridges, valleys, is on a 2-story house etc., it can cost considerably more.Hope that helps

My wife was arrested for growing medical marijuana in Michigan. At the time she had all legal documentation for growing. The Michigan State police and the county police did not care. They took all of the plants. There was a warrant filed at a later date. She turned herself in and bonded out. She got an attorney. At the first court date she did not even go in front of a judge. Her attorney talked to prosecutor and they had to wait for paperwork from Michigan licencing. When we arrived for her second court date they had received the paperwork and all the charges had already been dropped. She never even went in front of a Judge. The only reason the prosecutor had filed is that no where in the police officers report did it say anything about her having licence to grow. These officers are sworn to uphold Michigan law and they did not. They ignored the paperwork and took the plants. They failed to mention paperwork in the report and had her arrested. This has caused serious emotional, psycological, and financial burdens. Can we sue for this? They ignored the law and caused us harm. My wife now has an undeserved arrest record. Shouldn't they have to pay for the money that we are now out of because they were choosing not to follow new laws that they did not like?
Answer
I think that she might have a lawsuit, anjd I would be willing to talk to her. But where did this happen? In what county?

I filed for divorce in June 2012 and moved out of the home in October of 2012. I finally had my day in court(September 2013) to have the judge say she could not grant the terms of the divorce because the spousal support was not enough for me to be above poverty. So she granted the marriage over but not the financial portion. In November 2013 I bought some property with borrowed money and now the lawyer wants me to quit claim it. Is this really a good idea? My understanding at the time was that I had no worries about doing so since the marriage itself was over.
Answer
The court retains "jurisdiction" (ie the ability to go back into) the divorce. If the court left open spousal support, and even if it made provisions for it, the court can dictate changes depending on new or changed circumstances. Beyond that your situation is not clear - who was not above poverty, did you borrow money for the down payment on the property, and other facts are unclear. But if you did not have an attorney's assistance in the divorce, if is probably time to get one now -- support and related issues can get very complex.

A treatment treats a problem, and may lead to its cure, but treatments often ameliorate a problem only for as long as the treatment is continued, especially in chronic diseases.

My two children ages 13 and 14 sat down with me and stated they wanted to live me instead of their mother who is the primary residence. The main reason they expressed is neglect. Their mother has outright refused to care for them and buy them the things they need. My son explained that when he asks for clothes for school, etc; his mother tells him she doesn't have any money but he has witnessed her buying things for herself. Both children state they have witnessed their mother lie about where she is going to then sneak off and buy things for herself without the childrens knowledge. They named a long list of things but for the sake of being brief I won't mention them.
During our divorce which happened in 2005, she was charged with domestic violence. She forced her way into my apartment and assaulted me. I called police instead of retaliating and had her charged with domestic violence and filed a restraining order. She was ordered to take anger management classes. My attorney at the time stated a domestic violence charge disqualified her from gaining custody. For some reason, she still got custody. Several years later, the children disclosed to me that their oldest brother had been doing inappropriate sexual things with them. I recorded my children's saying this and reported it to the police. CPS came out and investigated and ordered that the oldest son could not be in the house with the children and my ex-wife was ordered to take some kind of family parenting classes. The son returned to the house but I do not know if this was authorized by CPS. The oldest son a year later was arrested for armed robbery and sent to Texas Juvenile Justice Department for a year or possibly longer, I'm not sure. It's a bad environment for my children and now they are pleading to come and live with me. Their mother is unstable, she moved from the house she was renting, possibly evicted to a two-bedroom apartment that currently houses 5 people. My daughter has told me she is sleeping in a walk-in closet in her mother's room. My ex-wife earns about 40K a year with an additional 14,000 in child support from me. She also had another child after we divorced, I don't know if she's receiving support from the father but I'm sure she is. Point being, she is not some poor mother struggling to make ends meet.
My first question is SHOULD SHE EVEN HAVE CUSTODY OF THE CHILDREN. We were in court to have the child support order modified as she does routinely to ask for more child support, the mediator stated there was a report of family violence on file, when she realized it was AGAINST HER and not me, she tried to recant the statement. WHAT AREN'T THEY TELLING ME ABOUT THIS FAMILY VIOLENCE?
My second question is IF SHE AGREES TO ALLOW THE CHILDREN TO LIVE WITH ME, WHAT ARE MY NEXT STEPS? (Child Support, Change of Custody, etc;)
Answer
The children are over the age of 12 and they can talk to the judge in chambers. Their request is not binding on the judge. Most judges will appoint an attorney to meet with the kids and the parents and determine what needs to happen. Both parents pay for this attorney's time - starts at around $1,500 each.
You might try mediation. I do a lot of custody mediations. My price is $300 per side for 4 hours ($600 total).
If you just need someone to draft the paperwork and submit it to the court, call me. I do uncontested custody cases too.

My final divorce decree shows my middle and last name. They left off my legal first name. I have to now file with the circuit court some type of form that states that the name on my birth certificate is one and the same as what is on my final divorce decree. How would I go about doing this? The circuit court in the county where my divorce was final says they have never heard of such a thing.
Answer
You need to file a motion with the court that issued the decree asking it to amend the decree to state your legal name. The decree should have tracked the name on the original complaint and all subsequent pleadings. If it didn't, this was probably some typographical error by whomever prepared the decree.
Is the BYU flats tongan test hard?
If you are planning on taking the Tongan Flats Test by BYU and are born and raised in America I suggest you STUDY! LOL.
Here is an outline of the test since its still fresh in my memory:
It is a 150 multiple choice test.
The first 50 questions is very simple. It is an audio recording of a man and a woman speaking in Tongan. They will say very simple phrases such as: "I went to the hospital because I was very sick. The nurse told me to take medicine because I have a high fever." Afterwards they will ask you questions and you have to select the answer that best fits the question.
The last 100 questions tests you on your grammar and reading comprehension.
The grammar section basically has you select the best word choice that fits in the blank. It gives you choices such as: a, e, 'e, o, ne, etc. The grammar section I believe is the hardest.
Reading comprehension uses scripture, folk tales and letters to quiz you on what you understood. The test that I took used 1 Corinthians 13, the legend of how Tongatapu was pulled out of the sea, etc. The first couple of paragraphs asks you questions in english. So it'll have the story in Tongan but the questions were in English. The last couple of stories had the stories in Tongan and the questions in Tongan as well.

Talk to a family law attorney in our county. The attorney will probably want to talk to your witnesses to determine what "touchy" means. If she denies an intimate relationship I don't know how you will prove it.

My lease is up at the end of August. Can I give a 60 day moving out notice at the beginning of July or do I have to wait to the end of August before giving any moving out notice?
Answer
Unless your lease requires notice that you will not renew, or extend month-to-month, you do not have to give any notice that you will be vacating at the end of the lease. It is common, however, for a lease to have express provisions for it to convert to month-to-month at the end of the term and requiring notice if you do not intend to stay past the end of the term. You have to abide by the terms of the lease in that regard. I can't imagine (and it would probably not be legal), however, to have a term that you cannot give earlier notice than required. Also, even if not required, it's a good idea to give sufficient notice and a demand for the landlord to do a walk-through with you and identify anything that needs to be repaired or cleaned in order to get your deposit back. The landlord is required to do that if you give adequate notice.

Why are there no Starbucks in Norway?
The only thing stopping them is the huge bureaucracy of the Norwegian government and all the red tape they make you go through to start a business here. It's EXTREMELY expensive, but Starbucks will find out that people pay upwards of $7 for small lattes here in Norway, so they can do the same.

How do you view tax records for a local non profit company?
You cannot view someone else's tax records no matter who they are.If they wish to allow you to do so for so reason, they can let yousee them but no one else is going to give you access to thisinformation. A non-profit company does not have to prove to youthat they are non-profit, but only to the IRS. If you believe thatthey are not what they seam, I would suggest reporting this to theIRS. They will investigate and will never tell you the results. They are not allowed to do this due to privacy laws.

Yesterday I received a bill from the City of L.A. for a drive-by inspec. of my trees. I already have an appt. w/ my tree trimmers scheduled for later this week. So far this yr. I've paid $3000--will pay another $1000 this week to finish. My tree trimmer, who used to work for the Fire Dept. in this area, was surprised a BILL was the 1st communique from the City--- He said if there was truly a problem I would've received a letter from the Fire dept. FIRST. Coincidentally, I've scheduled the trees done in a couple days ANYWAY-- can I then prove to the City thru pix, receipts, that the work's done and avoid paying this fee? I strongly suspect this has been a retaliatory effort by my "neighbors" who car recently blocked my driveway for so many hours I had to have them ticketed. Please help. Thank you so much.

An attorney would have to review the notice to specifically advise you.

Product sourcing refers to finding/buying products either from domestic/international markets.
There are several ways whereby one can conduct product sourcing for instance via:
- B2B Portals: An online portal where buyers can find useful buying leads and access to a wide range of products & suppliers.
- Trade shows: One stop approach whereby buyers can meet suppliers face-to-face.
- Trade publications: Buyers can preview latest products as well as a wide range of suppliers.
- Search Engines: A conventional method of searching for products by typing product name/type in the search engine. However, some buyers are skeptical about this method as they can't be too sure about the reliability of the supplier.

MY WIFE FILED A DIVORCE PETITION AND I WAS SERVED IN OUR RESIDENCE. Now just yesterday, she asked that I move out of the house by the end of the month even before I have responded to the petition or before the matter has been heard by the judge in court. She is even treatening to have me removed if I am still there at the end of the month. Is this legal? I believe that since I was served at this location, if i moved before the case is set for hearing, i run the risk of not being easily reached or contacted by the court thereafter for the hearing of the case. What do you think is the right thing to do now?
Answer
You don't have to move unless the judge signs an order that you must move.

Is Beckford Financial Services real?
NO! It is not real. It is a SCAM!!! You can check on Askapedia - there are LOTS of people who have SENT them MONEY in order to SECURE A LOAN and NEVER Received their loan/Check. We have tried to contact the FBI without much avail. As directed we posted the complaint/info on IC3 FBI Site. Have NOT heard back from them yet. The Building they claim to be in is a Residential Condo. None of the phone numbers show up as where they claim they are. They have a SLICK answer for everything. DO NOT SEND THEM ANY MONEY! THEY are ripoff artists. If it seems to good to be true, it probably is. In this case This company is BAD NEWS!

Why are there so many baby boomers?
It is my understanding that the "baby boom" resulted from the return of millions of young American men (and women) from World War II.Having been away from the US for as many as 4-5 years, the returning GIs immediately sought out their girl friends (or wives), married them (novel idea, no?) and proceed to produce babies in record numbers. The US economy was booming after the war, and there was a huge spike in the number of babies born in this country. These babies - born starting in 1946 and lasting thru 1964 - are known as the "baby boom", hence "baby boomers".

I was helping my boss set up a temporary beam for a roof. He was using a tractor to lift the roof. I had to stop and grab a block to put under the beam . He set the roof down and then hit the hydrolics on the tractor and the forks came crashing down on my head a 8 foot fall and they weight at least 400lbs. I have a three inch split on the top of my head and suffered my first concussion. He asked me not to go to the er when it happend. But the next day when I went back to work my symptoms of concussion were so bad I couldnt work so I visited the ER. Its been almost two weeks he hadnt said anything about paying for the bills. Yesterday I asked him how he planned on handling it. He said that before he paid anything that I had to write a letter to the hospital stating that I couldnt pay for my medical bills and if they would please lower them. Only after that would he compensate me for lost time and medical expenses. I asked him to just file workers comp in a text and that I wasnt comfortable being dishonest with the hospital. He sent me a text back suggesting I take time off from work. Do I have the grounds to sue him for more than medical bills and the days I missed from work monetartily. I suffer from post concussion symptoms everyday Im being completely honest and gave him more than enough time to make up his mind on how to handle this. I feel I have been kicked to the curb and for that I wish to sue its just not fair.
Answer
If you were an employee, and not an independent contractor, then you should not be relying on your boss to take care of you, particularly if you have suffered a concussion. You need to immediately speak to an attorney familiar with Virginia workers' compensation to protect your rights. More than likely either your boss has not reported this to his insurance company so his rates won't be affected or he has no workers' compensation insurance and is trying to conceal that from you. Remember it is your responsibility, not your boss's, to file your claim for workers compensation. Feel free to call if you have any questions.
Answer
It appears you were an employee at the time. If your employer did not have more than two employees, then he was not required to have WC Insurance on you. He still could have it. If he does not have more than two employees, then he was not required to cover you with WC Insurance. You may have a right to sue him for causing your injury if he "negligently" caused your injury by dropping this on your head. You could have that right if he has no WC Insurance. You have a concusssion and you may have a brain injury so it is something you definitely want to consider pursuing. Whether or not an attorney would be willing to sue your employer depends upon whether the case can be proven and whether there is a reasonable chance of recovery. My father passed away without a will - he had three children from his first marriage and he was remarried. they lived in louisiana. all threee of his children live in texas. a few months before he passed he sold his business and opened an account - he put my step mother and my brothers name on the account in order to pay his bills. they have split the account between them. he also had a ubs savings account and a life insurance policy - my question
is do i and my siblings ( we are not step children) have any right to his estate?
Answer
Even though he put the names of others on his account, the account is still part of his estate. His half would go to his natural children equally. Same with the UBS account. The life insurance policy would be paid to the beneficiaries named in the policy.

The 2nd Amendment is a restrictive clause forbidding the government from infringing on that right. Should it not then follow that all firearm laws are unconstitutional?
Should it not also follow that, as a branch of government, the judiciary, particularly, the Supreme Court, can only, by Constitutional Law, rule every and all cases involving firearms legislation or regulation to be unconstitutional. In Fact, should it not be that to otherwise rule in favor of any firearms legislation, even under the Commerce Clause, would place the Court itself in violation of the Constitution?
Answer
While I and the united States Supreme Court agree that the 2nd amendment is an individual right (in the past many had argued it only gave the govt the right to arm militias like the national guard), no right is absolute. For instance, the right to free speech does not give you the right to shout "fire" in a crowded theater if there is no fire.
Thus the courts have held that the second amendment preserves an individuals right to bear arms as that right existed when the 2nd amendment was first enacted. The founding fathers would certainly have had problems with citizens owning nuclear or chemical weapons yet these are arms. Some would say that they would also have a problem with citizens owning fully automatic weapons though that is debatable.
But most would agree at this point that firearms cannot be banned, but reasonable limitations can be placed upon them so long as those limits are in keeping with the intent of those who enacted the 2nd amendment.
Answer
Mr. Willison is largely correct. No constitutional right is absolute, and the right to bear arms has limits. Mr. Willison says that "most would agree" that these limits are the ones the founders had in mind over 200 years ago. Many would agree with that premise, but probably not most. There are many opinions about how those limits should be defined.

How does revaluation of inventory affects the cashflow statement?
Revaluation of inventory has no net effect on the cashflow statement as there has been no movement in cash.
If the value of inventory is increased, the debit entry to inventory revaluation is negated by the credit entry to the revaluation reserve / shareholders' funds.
If the value of inventory is decreased (more common), the credit entry to inventory writedown is negated by the debit entry as an expense or cost of sales item through the "statement of financial position" to retained earnings / shareholders' funds.
Treatment and disclosure of course would vary depending on the materiality, timing, accounting standards applicable to the jurisdiction and legislative / regulatory requirements with which the entity is obliged to comply.

Why should customers buy local and seasonal products?
In basic terms the purchase of produce from local suppliers means that the local economy benefits. This includes the cash flow through the area, employment for those people working for the supplier and the off shoot "other businesses" in the locality which will see the benefits of the financial turn over across the environment.
season products; Its a fact that when not in season there is a higher cost implication in "transporting in" from other countries or states. This impacts of the wholesale and retail pricing of the products as it encounters additional costs in transport. The suppliers of that product will be thereafter spending in their own country etc. Add to this is the additional cost of growing locally out of season produce. The costs are high as the produce is "forced", it is frequently, if vegetables, fruit etc costly to heat manually pick and crop and then it has to be priced against any-other supplier who may ship in.

What is 'joint supply'?
Joint supply According to the Economist's "Economics AZ" dictionary: "Some products or production processes have more than one use. For instance, cows can both provide milk and be eaten. If farmers increase the number of cows they own in response to an increase in DEMAND for milk, they are also likely to increase, a little later, the supply of meat, causing beef prices to fall."

Do you pay commission on gross profit?
It's not typical in any industry that pays commission. To be clear, there is a different between gross profit and gross sales. Either way, paying commission on either is not the standard.Gross profit and gross sales implies a number beforing taking out sales taxes that a company must pay.Typically, commission is paid on net profit or net sales because the "sales person" because the company has to pay the taxes and the sales person had no bearing on these taxes.Look at it this way. When tipping (which is really like paying commission) a waiter/waitress, you should tip on the amount before taxes are added not after. Taxes are a product of the state laws, etc, not the business charging the taxes. The waiter has noting to do with something the state charges.

I may be incarcerated soon and I want to make my son my General Power of Attorney. I have thoroughly looked through the people of whom I could make my "Agent" and my son is the most worthy candidate. With that being said, my son is 17 y.o.a and won't be 18 until a few months from now. Does he have to be 18 in order to be my assigned agent? What are the requirements that one must have to be an agent?
Answer
Merely by now giving your son a general POA would not confer upon him rights
as a minor that he cannot acquire by law until he reaches his majority, i.e.,
age 18, and therefore I see little point in it until he has all the rights of an adult
and can then exercise fully the powers in your behalf that he has been given under this POA.

I just found out I missed my court date on may 13th 2014. I had a public defender but as far as I know she hasn't tried to contact me. I originally went to court on April 4 2014. I am 28 years old have 3 children and am married to their mother. So obviously I need to be here, and need to figure out what exact steps I should be taking so I can continue to provide for my family. Thank you so much for any help or insight you can provide. I wish I had the money to just pay a reputable attorney, I really hope not being able to afford it doesn't turn out to be the beginning of my worst nightmares.
Answer
Perhaps the court might recall the warrant, if it finds that you have a good reason.
An experienced criminal defense attorney can help you evaluate the prosecution's case, any defenses that you might have, and any plea offer that might be made, so that you can decide whether to go to trial. Consider seeking a confidential consultation.

So, a 16 year old girl and an 18 year old boy are close friends. She goes to his house to seek comfort over a bad dream (she has ptsd) and falls asleep, she wakes up to him molesting her later that night. At first she froze up after realizing what he was doing, then told him to stop. He stopped and after trying to lie and say nothing happened (he thought she was asleep the entire time) he admitted to molesting her, his reason being "you were asleep so I figured why not". If she wanted to press charges against him how exactly does that work? Is it considered an offense against a minor or something else? What is a likely sentencing for something like this? If there is even a case at all, she is now 17 and he is now 19. She has very little proof of the event, but it is something. (text messages of him admitting what he had done). Help.
Answer
Its not about offense against minor because she is age of consent (16). However it is criminal by definition because she was asleep and did not consent. I have no idea what you mean by "molest" but if there was intercourse it is rape. Anyway if she wishes she should contact the police in the place it occurred.

I bought a washer from a guy from Craiglist and he gave me a receipt and a 30 day warranty but now does not want to give me a refund after I told him the washer does not work
Answer
Your best recourse will be through the small claims court. So long as you can show them that he did in fact warranty the product. You do not need a lawyer to file that claim or represent you in court. This is basically what Judge Judy does and being in CA, if you are near to LA, you may even bring it there, which is really binding arbitration.
You may want to let him know that this is exactly what you intend on doing so he understands that you will make him waste his time.
Kind regards,

I was selling my home and received two offers that lead into a highest and best situation. I chose the offer that was the highest offer at that time although both were very close and my real estate agent verbally called the buyer's agent that won the bid letting them know the outcome as well as the other potential buyers real estate agent letting them know they were outbid. I was unable to sign the purchase agreement with my real estate agent until later that night because my real estate agent had other meetings. I just recently received a letter in the mail from the losing bid buyers telling me they had contacted my real estate agent within 5 minutes of receiving a call from their agent who let them know they were outbid. The potential buyers said they personally called my listing agent after receiving the news because they were unable to get ahold of there agent at that time. My agent never informed of this information before I signed the formal written contract accepting the other offer that evening when my agent was free. My agent still has never mentioned that $10,000 was offered. Is there any way for me to get out of the contract I am now in that is 10,000 dollars less? From what I have read my agent could have backed out of the verbal agreement because verbal agreements are not binding like formal written contracts. Is there anything that can be done? Obviously I would rather have 10,000 dollars extra but I also am aware that there is no way to prove they actually said that to my agent other than their screenshot they sent me of their call log.

My husband and I have been married for 10 years . We moved in together in 2000
In January 2002 we bought our house the was the one on title, we got married in 2004. We have no children. The downpayment was a loan from my dad and it was transferred by wire transfer to my husband account . We lived happily untill 2009, I am italian an I was deported for failure to provide additional information as requested on my Adjustment of Status Application. I was given a 5 year ban before i could re enter the country. My husband at first considered moving to Italy with me, but then he decided to remained in california while I returned to Italy . Every month I paid into his account to cover house and living cost for as long as I could afford it in 2009,2010, part of 2011, but in 2011 I lost the good job i had in Italy and I was no longer able to send him money. He visited me in Italy in 2009, 2010 and 2011 but only because I paid for his flights . When I was no longer able to pay , he stopped travelling. Meanwhile he found someone else and stopped talking to me , and he simply wrote me an email saying he had to move on, I tryed to call and reach out but he refused all communication. I asked a friend lawyer to talk to him and he told me that - we had nothing to talk about because the house was bought in his name before our marriage - I have not been able to return to california due to the cost of travel and I have saved for two years to come over and file for divorce and get justice. I wish to file for divorce and to receive what i deserve for the house and support. My parents gave us the money to buy the house he still lives in and I wish to give them the money back. I know that after 10 years of official marriage I have more rights, but I need help. I already have , List of assetts and liabilities and his credit report. I cannot afford a lot, but I am determined to get this matter taken care. I need help in 1. assessing the situation.2. planning a course of action 3. drafting an amicable offer .4 eventually filing for court hearing.
Answer
You really need an attorney. He is wrong that the house is his. The down payment unless it was a gift may be reimburse able. Any community amounts that were paid on this are subject to reimbursement or division. . Sound like you are top of things. It may be difficult but some of this you may be able to do from there. You don't need to be here to file, you may not need a hearing if you both do a stipulation. Your course of action would be to file and start this....if he is willing to deal it makes it easier.

Wife & I are separated. Part of dispute is my pre-marital assets (being contested). Court date is near, but for past 9 mos she "froze" all liquid marital assets .....leaving too little (my) income to pay necessary living expenses. Our combined incomes are sufficient to cover expenses, but she isn't sharing hers. is this legal .....freeze assets w/o cause, then refuse to contribute to marital expenses (e.g. mortgage, utilities, groceries, insurance, etc)? I contribute 100% of my income (she doesn't). Since her income is currently higher, she says I should be contributing pre-marital assets. I disagree & contend she is "dissipating" assets/income intentionally -- causing us to get behind on mortgage, utilities, etc. My attorney suggests not using pre-marital $ until courts have ruled. If I do, the assets may be construed as co-mingled. Used in the normal course of paying bills & therefore half hers.
Answer
I respectfully disagree with your attorney's characterization of premarital assets. Such assets are not subject to distribution by the court as part of a divorce proceeding, as I assume they have advised you. The fact that you were, out of economic necessity, obliged to spend these assets to cover your living expenses would not change this characterization. If your wife is dissipating marital assets on non-necessities, the court can take that into account in dividing up remaining assets. Your attorney could also seek a pendente lite order to free up marital assets that she is controlling, as well as an order obligating her to contribute to the upkeep of property (mortgage, insurance, etc.) during the litigation.

My daughter and I are on-site apartment managers for 24 units. we have no rental agreement or employment contract. we repeatally ask for them, my manager and the owner seem to ignor our request. what adavanages would they gain from this and what can we do about this and who is in the wrong.
Our rent is 700. a month which 400. is deducted for being managers. we are required to work out of our apartment from 10 am - 2 pm tues. through sat. even though we work on our days off and pretty much 24/7. Is this legal and could this be grounds to sue?
Answer
There is no wrong or right in having or not having a written employment agreement for apartment resident managers. It is, however, illegal to pay a manager in part or full with a rent credit without a written agreement. As for your compensation, it sounds like they are in serious violation of wage and hour laws as well. If $700/mo is the fair market value of the apartment, deducting $400/mo is legal. They can deduct $668.46 for two people, or 2/3 of the fair market value, whichever is less. However, if that is your only compensation, then you are being seriously underpaid under California wage and hour law. The rent credit can only be made against at least minimum wage. So they can only work you 50 hours per month for both of you combined for that $400 rent credit. Anything over that they must pay you at least $8/hr. Being "on call" as managers does not count as time worked, but time spent actually dealing with tenants or issues with the building does, whether it is during your regular 10-2 shift or any other time. The better your records of your time worked, the stronger your case will be, but it sounds like you are being very seriously underpaid no matter what. I handle cases throughout California, and have an association with an attorney in your area for cases in Fresno. If you would like further assistance with filing a claim for your unpaid wages, please let me know.

Trust contest I currently have a living trust, and a special needs trust within for my,Son when I pass away my L.T will fund his S.N.T . I have a lot of changes I want to make and add additional provisions in both, should I do a complete revision and restatement to my current trust or should I void these trust and start over so I can have a stand-alone S.N.T for him. I am also concerned my other,Son will contest (he has only come to visit me 2 times in 55 years and never calls. I don't mind spending the extra money and start over if if it is better to do so, I have to be certain he is taken care of ...Thank you very much
Answer
I recommend a complete revision. It is easier for the drafter (and thus better for you) to work from the drafter's standard form, and the extent of revisions you describe make a new form preferable anyway. You can insert a no contest clause in your Trust, but that clause is subject to the statute allowing contests for which there is probable cause. Under these circumstances, a well drafted Trust is likely to pass that test.

My mother wash receiving child support for me until i graduated from college just like my siblings before me. She recently passed away and i have one year left of college. What happens to the child support? also does it change if i go on my fathers health insurance? would it be better to get insurance through my school?
Answer
Child support is no longer payable by your father once your mother passes away. However, your father may still have an obligation to support you. Since you will need to discuss with your father getting on his health insurance, why not discuss with him how your college expenses will continue to be paid.
Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. You will only be able to rely on advice from an attorney who you have actually retained. Good luck! Rob Gleaner

If at that time, it was a standard practice to prescribe that medication for for patients suffering the same medical problem as yours, there is no malpractice. The other question is whether there may be a cause of action against the drug manufacturer.

I have 50 50 but still pay child support. How can I stop child support?
I have 50 50 but still pay child support. How can I stop child support?
Answer
Just because you have 50/50 placement doesn't mean child support is $0. There is a complicated equation to determine child support. Search for "WI DCF-150" and there you will find how to calculate it.
If the new calculation is lower than you are paying then you should seek a free consultation with a local attorney before you file a motion to modify. There are lots of reasons the court may have ordered more than the calculation justifies.
Answer
You would have to apply the child support formula to your situation to determine what, if any, child support is payable. Having equal custody does not mean there is no child support obligation. You should consult with an attorney to determine whether you may file a Motion to modify custody or parenting time.

I received a letter informing me of being named as an heir to an estate will. I also received a copy of the will. Is there anything I am required to do? The attorney that sent the letter isn't returning my call. I understand that I am not their client and they are under no obligation to return my call. Thanks in advance.
Answer
It's really impossible to answer fully without knowing more about the situation. You probably received the letter (and also should have received a couple of standard notices of your rights) because the executor is required by law to send notice to all heirs and legatees within 14 days after the estate is opened.
You mentioned that you are an heir. Are you also named as a beneficiary (legatee) in the Will? If you are only an heir and not a legatee under the Will, then unless the Will is not admitted to probate or is contested you will not receive any distributions.
If you want to discuss the situation and your rights, you should contact your own probate attorney.
Answer
The word "heir" means the person(s) under state law who inherit if there is no will. If there is a will, the persons who receive property are called "beneficiaries." State law requires that all heirs receive notice concerning probate of the will so the heirs (especially if they are not beneficiaries) have a legal opportunity to contest the will. If you are not named as a beneficiary, you are receiving notice because law requires you to receive notice and under most circumstances, you will be asked to sign a paper signifying that you are OK with the status of the estate and release the estate from any duty to keep sending you notices. If you have doubts as to whether you should sign anything, don't sign it. Take your copy of the will into an attorney's office for a consultation taking your facts and circumstances into account, for a custom opinion which no online resource can provide.

I lost my job a few months ago. I lost it because I couldn't remember some things that happened in a startup meeting. after i was suspended i remembered what happened and called them back to tell. They asked me why i didn't tell them what happened I told them that i have a bad memory and didn't remember at the time. The company concluded that i was not truthful so they fired me. I've recently found out that my memory problems have been traced to sleep apnea and low Testosterone. Is it possible to get my job back in light of this undiagnosed illness?
Answer
Probably not. If you had notified them of your illness/disability and they terminated you, then you may have a case under the ADA. But it sounds like they terminated you, an at-will employee, for cause.
The more pressing question is whether they had a different reason for firing you. Not remembering some comments from a start-up meeting sounds like it could be a pretextual reason for a termination. Do you think they were motivated by something more insidious?

If the Notice of Deposition states that there will be an electronic record (audio or video) then you can make a request for a copy. The tape recordings are just for the court reporters use only as an aid in transcribing the deposition and neither side can get copies.

Upgrade? I think you are misunderstanding a lot here. One of our clients has made INC's Top 50 US Companies for two years in a row and has over 100 employees. He is still an LLC.
I really do not understand your objectives. There is no definitive point in time when you are compelled to change your structure. You do so when it will be beneficial. Like if you are hiring employees, achieving greater revenue, attracting institutional investment capital, etc.

Hello,When I was 18 years old I shared a bank account with my mother when I was in college. She received money orders that she did not know ...
Hello,
When I was 18 years old I shared a bank account with my mother when I was in college. She received money orders that she did not know were fake and deposited them. She had thought they were a Christmas gift from one of our family members. The bank accepted the money orders and everything was fine. This was all unbeknownst to me by the way, I was just going through the college routine. Well apparently the money orders she deposited did indeed turn out to be fake and we were required to pay the balance. Which we did, and we also filed a police report as asked by the bank to do so. So after the whole ordeal we closed the account with PNC. I moved away and when I went to open a new account at a new bank I was declined. I am 24 now and I was just recently able to re-open a bank account after a long and drawn out process through PNC itself, and a company called chex-systems. I have reports from Chex systems that say there should be no black mark on my account as we settled the balance immediately, however, someone at PNC put something on my bank record that essentially lowered whatever score they use and now I am just above being able to open an account. I have to pay higher fees for my account because of a mistake that someone at PNC made years ago and never answered for. PNC themselves said that there should not have been a dispute on my record. But there is, and now my record reflects that I have essentially attempted fraud. This is absurdity at its finest and at this point I have not been able to find the proper channels to get this resolved. I believe that I have been wronged and am continually paying for a mistake someone made years ago that I was not even aware of.
Please let me know if you have any input on this.
Thanks
-J
Answer
Speak to a civil litigation attorney. There are a number of ways in which PNC can make this right and it seems they are refusing or claiming inability to do so.

We are being sued by a credit card company. Can they take the debtors social security and pension?
Gary
Answer
They are exempt.
Answer
Social Security and pension payments are exempt. I still suggest that you consult with a bankruptcy attorney, most offer free consultations. You should discuss your entire financial circumstances to decide whether allowing creditors to simply obtain judgments against you is the best course of action. If you own your car or have other assets that a creditor may seize you may be well served to consider bankruptcy as an option. Best of luck.
Answer
I would suggest you consult with a consumer lawyer. Credit card companies very seldom win these cases if the debtor is represented by a consumer lawyer. see www.ConsumerLawyerHelp.com

can I sue my landlord for property damage?
I requested a different parking spot when our apartments were being remodeled and was denied. The spot I park in caused damage to my vehicle. No other party was involed.
Answer
Parking spots generally can not cause damage; they are inanimate objects if anything. It might be too small making parking difficult, or there may be things dripping into it....true. But in the end you have to look at your lease to find out what the landlord's parking obligations are and your parking rights are. If there's dripping, that's one thing. If it's too small, another. If you are disabled, however, and the landlord is subject to fair housing obligations and did not take your disability into account, you may have a case. But suing your landlord, think about it. Even though landlord's aren't supposed to retaliate against tenants who assert their rights.....at some point they can say "b-bye" legally.
