Talking by phone, corresponding by Facebook and texting with someone your husband has not met in person would probably not be considered "cheating", but it would depend on the facts and circumstances of each case. But, generally, where someone has not even met face to face with a would be "paramour", would not be considered cheating.
There would have to be a divorce action pending in the Court in order for the Court to Subpoena someone's phone records, or any other records for that matter. So, if a divorce action has not been commenced by the filing of a Complaint in Divorce with the Court of Common Pleas, you would not be able to ask for a Subpoena.
If, during your 21 year marriage, your husband did not want you to work and demanded that you be a "stay at home" wife, then you might probably be entitled to more than 50% of the marital assets, including your husband's business. And, for the same reasons, you would also be entitled to "Alimony pendente lite" which is alimony during the divorce proceedings and also be eligible for alimony when the divorce decree is signed by the Judge. However, in Pennsylvania, alimony does not go on forever. A Court will award alimony which the law expects the recipient spouse to use to acquire a skill in order to be able to enter the work force and become self-supporting. For a 21 year marriage, you could be eligible to receive alimony for approximately 6-7 years, depending on the age, health, education, and several other factors of both the husband and the wife.
In Pennsylvania, the law wants to see both the husband and the wife represented by their own Attorney. All the work the unlicensed subs do end up needing to be redone or replace. We discovered the unlicensed subs when we requested a list of all the subs from the GC and researched them online. The GC is willing to fix all the work, but it MUST be fixed by his unlicensed subs, he refuses to use anyone else. We flat out refuse and requested the GC terminate the contract with us. He will only do it if we give him a substantial amount of money from the last draw (which we are holding). What can we do to get this GC out and avoid him placing a lien on our house?

Hello, I recently agreed to sell two 80s era Kenwood ham radio receivers to an individual out of state. The receivers belonged to my dad who passed away ten years ago. I'm not an expert with the radios and was selling them to help my mom. The buyer, whom I first dealt with to buy some power cables for these particular receivers runs a business restoring these old units. He had some questions about the receivers which I answered. All the problems I could find were disclosed to the buyer at which point he offered $450 plus shipping for both receivers. I felt that was low and asked for $650 plus shipping to which he agreed via email. All of our correspondence has been via email and I still have all of them. The buyer them asked for me to ship the receivers without payment, and stated that is how he usually handles buying used equipment. I asked for a good faith deposit of $150-200 before shipping and he sent $175. Once he received the receivers, he is now trying to back out of the agreement because they have more problems than he knew of. As stated I told him of all the problems I could find with my limited expertise. Is the original written agreement binding in a case where items are unseen?
He is now saying he would send them back to me and pay part of the overall shipping cost. I don't yet know how much that "part" would be.

As the old saying goes, "possession is 9/10ths of the law," and you have now placed an out of state party who is merely a potential buyer in possession, which is almost never a good idea unless the deal is nearly certain, or unless the items are easily recovered intact if the sale does not close. You should have dealt with the issue of return shipping in the event of refusal before you shipped the goods out of state to him (you could have requested a security deposit from him for such expenses). You could now argue or litigate with him over that expenses later, but the outcome would be uncertain, and he would retain possession of some valuable equipment in the interim. It would also be difficult if not impossible to sue anyone without spending more than the value of these items, even in state, much less out of state. You have allowed yourself to be placed over a barrel, and therefore now have very little practical choice other than to renegotiate a price that will close the deal. One item available in your negotiations would also be how well you will rate one another on the website used for the sale.

While checking the status of the probate on the court's website recently I noticed the message "Amin Proceeding Disposed" noted next to the entry naming my caveat as having been filed. Why would my caveat be disposed of when the probate is still ongoing? I thought the caveat would remain in effect and the court would be required to send me copies of all documents and information filed with the court until the conclusion of the probate. I'm seeing documents labeled as "confidential" in the list of documents etc. being filed with the court which I have not received copies of, as well as other documents I have not received copies of.

The caveat is typically filed prior to the probate itself. It puts the filer of the probate on notice of your claim. You are to be notified about the filing of the probate. After that the obligation is on you to file any appropriate claims. Seek some legal guidance and don't rely upon the clerk's notations in the docket. The inventory and will are confidential documents not subject to review by anyone not associated with the case.

While waiting to be officially named executor, another brother misrepresented himself as the representative for the estate and signed a new lease with the company that owns the apartment. The new lease is in the name of the estate with him signing as representative. He told me the apartment was no longer in my parents' name and was now in the name of the brother who lived with my parents and that the brother who misrepresented himself was the financial backer. I contacted the landlord to be sure and found out I was lied to. The landlord also told me they make no financial agreements where someone backs the person living in an apartment. First of all, it's not even your house (until there is a probate). And at some point, the house will be lost to foreclosure. Since you haven't bothered with probate there's no way to even cut a deal with the mortgage company. You needed a lawyer a year ago. Get one ASAP. This will turn out horribly without counsel. It may possibly come out better with good legal help.

First, what is the property worth? How much is owed on the first mortgage? The second mortgage? How much equity, if any is in the property?
What other debts are there in your mother's estate? What other assets are there?
What are your plans for your mother's home? What, assuming title is in your name, do you want to do?
If there is a first and second mortgage, no equity and you do not live in the home, then don't pay and tell the bank to come and get it. The first mortgage lender will foreclose and the second mortgage will be wiped out by the foreclosure. The second lender may decide to sue your mother's estate but if there are no assets in her estate, that may not be likely. Of course, you will not have this home.
If you live in the house and want to keep the house and if there is some equity in the home then the logical thing would be to refi the home and get the mortgages combined at a favorable rate that you can afford to repay. However, this depends on what other debts and assets are in the estate. Heirs cannot receive anything until all the bills in the estate are paid and you would have to go through probate.
As a practical matter, if you do not listen to any advice and just stop paying, then in all likelihood, I can see the second lender just suing your mother's estate on the note rather than foreclosing unless there is substantial equity in the property. However, it is not unheard of for second lenders to foreclose so there are no guarantees here. If the sue rather than foreclose, they will recover a judgment if that happens which will be a lien on the property - you will not be able to sell the property until this amount is satisfied.
You really need to think about the property, what its worth and what you want to do. If you want to salvage the home, then you need to get up with a probate attorney now.

eYou will have to comply with insurance company requirements if you want insurance. Period. That means you will have to pay a roofer to certify the roof. If no one will do that without substantial expensive work to the roof, look for other companies to insure, but don't be surprised if they all have the same requirments.

Bottom line, anyone can report the crime to police with nothing to lose. Police, and then prosecutors, will decide and determine if they are willing to accept the filing and push prosecution if the SOL has not expired, and there is evidence sufficient to make it reasonable to do so.
In civil cases, a minor has until, at most, their 26th birthday to file a lawsuit against the perpetrator of sexual abuse, but the minor faces the test of whether it is practical to do so. Judgments can stay on your credit report for 7 years from the date of entry. But judgments never go away. They remain in the court records forever. They can be enforced against any real property for 5 years but can be renewed for additional 5 years and can be enforced against personal property (like cars and bank accounts) for 20 years in Pennsylvania. Other states have different rules.
So not paying is not an option unless you never plan to open a bank account or but a home or a car in your own name.
I would be less concerned about your credit report than I would be about the possibility that someday the creditor is going to seize your bank account when you least expect it. If the judgment is in a state other than PA, then I would also be worried about wage garnishment once you get a job. And moving to another state will not be helpful because creditors can transfer judgments to any other state where you live, work or own property.
If you pay or settle the judgment, the creditor will have an obligation to mark the judgment as satisfied. Mortgage lenders do not care that you have a judgment against you so long as it is satisfied.
And the unpaid judgment may hinder you from getting a job or an apartment (it will definitely prevent you from getting a mortgage and buying a home in your name) depending on the type of work that you do. Some of my clients who work in some capacity and have a security clearance have been threatened with the loss of the security clearance or job because of their debts.
As to how you pay the judgment, there are options.
(1) I find it somewhat difficult to believe that you had no knowledge about a lawsuit and judgment until you reviewed your credit report. Lawsuits are commenced by filing a summons and complaint which must be served upon you. If you had no knowledge and there was no service of the complaint, how was the judgment obtained? Were you sued in PA or was the judgment entered in another state? How was service made? Depending on the answers, it may be possible to challenge the entry of judgment. What was this for? A credit card or some other kind of debt? Was this your debt? Again, if this is for something for which you are not responsible, it may be possible to challenge.
(2) Assuming that the judgment is proper, how much is the judgment for and what is the current balance? Judgments earn interest at a rate of 6% if it was entered in PA. Again, what is this for? If for something like a credit card or even breach of an apartment lease, it may be possible to settle this for something less that 100% depending on how much you can pay in a lump sum.
(3) Once you determine that you owe the money, I would get a copy of the court file and see who the plaintiff was in the lawsuit. Is that the same entity as reported on your credit report? Contact the law firm that obtained the judgment for the plaintiff or contact the plaintiff directly. If you can settle for something less than 100% of the debt, get the terms of any agreement in writing - the essential terms would be the case or file number, any original account number, the full balance of the judgment, the settlement amount, when and where it must be paid, and the name of the payee on the check. Get a physical address. And get a statement to the effect that the judgment will be marked satisfied once the settlement amount is paid.
Once you get the settlement letter, get a money order or cashier's check for payment of the settlement amount. Make a copy of it before you send. Send the check/money order and a copy of the settlement letter to the plaintiff or law firm before the due date so that the funds arrive by the due date. Use UPS/FedEx so that you can track the delivery and make sure the funds were received.
In 30 days, follow up to see if the judgment has been marked satisfied and get a final closure letter. Keep a copy of your payment (the check or money order), copy of the settlement letter and copy of the closure letter FOREVER.
Make sure that the judgment is marked satisfied. If the plaintiff has not done this in 30 days, then give them another 30 days. If it still has not been done (check the court file) then you write a letter and demand that the judgment be marked satisfied. There is a statute requiring the creditor to do this. If they still refuse the creditor would be liable for damages and your attorney fees. I have never had a creditor refuse yet.
Once you get a copy of the satisfaction of judgment, you write to all 3 credit bureaus and ask them to update your credit file to reflect that the judgment has been paid. Include a copy of the satisfaction of judgment with your letter.
The credit bureaus have their own people check judgments and not all creditors report to the credit bureaus - judgments are something the credit bureaus do own their own. The credit bureaus should indicate to you if the report has been updated.

I recommend that your talk to your case's prosecutor's office. While the court's probation department is required to contact the victim for an impact statement (and may have its own form to use) the prosecutor's office might have a handy form, too, and be able to help you with details of what to say or ask. The victim's rights laws do not tie a victim's hands in what he/she asks the court to order at sentencing. The judge will consider your recommendations, along with the prosecutor's, defense attorney's and probation department's. CSC 4th Degree carries up to 2 years in prison (unless the defendant was also convicted as a habitual offender) as the maximum time that can be served by statute. But the sentencing judge sets the MINIMUM time to be served, and makes the critical call of whether the defendant will be sent to prison at all, serve county jail time, be put on probation, etc. If probation is ordered at sentencing the judge will set terms of probation the defendant must follow, and your impact statement might want to emphasize terms that are important to you. Some examples include not having ANY contact with the victim or members of the victim's household (direct, indirect, social media, etc.); not violating any criminal laws anywhere; not possessing or using alcohol or illegal/non-prescribed drugs (especially if these were part of the crime's dynamics); not possessing weapons like guns, knives, etc. (again, especially if this was part of the crime dynamics); completing counseling recommended by probation or any assessor (such as a psychologist, substance abuse screener, etc.); performing ____ hours of community service; etc. The list can go on, but the judge should focus probation terms to things connected with the crime itself or issues the defendant has that might lead to continued criminality. The bottom line for victim impact statements is to ask for it if you want it. It's also helpful to explain why you think specific things might be important. Also, in general, your impact statement should include information on how this crime affected / impacted the victim and the victim's family. And don't forget about restitution (e.g., co-pays, mileage or other out-of-pocket costs for counseling).

#1. The court will exercise jurisdiction only from the date of filing the petition, not before. #2. It's up to you; you really don't need to in my opinion. Perhaps she could bring a contract claim for breach of contract in civil court but I don't think it would be successful. However, will your child suffer if you stop paying? It takes money to buy food, clothing, school supplies, etc. Note that she has every right to ask a court to order child support. Child support is standard in divorce cases with minor children involved. As for custody, the court will not order joint custody unless both parents ask for it. You should sit down with a family law attorney to get a better understanding of the law, your rights, and what is reasonable under your circumstance.

No in most cases (like for a credit card debt). The exception might be for a "necessary" like hospital/medical debt (although that appears to have been abrogated by GA law if the debt is in GA). If the husband dies, the wife may be indirectly liable in the sense that these debts would be claims against the husband's estate. Claims have to be paid first before the heirs get anything other than the yearly allowance paid to the spouse.
There are many other considerations so just saying the wife is not liable does not end the discussion. What assets does husband own? How are they titled? What about bank accounts? Having a joint account between husband and wife places money at risk if the husband owes debts and his creditor gets a judgment against him.

Actually, this is a bit of a challenging question. You haven't indicated whether this is a public or private college/university. Sororities and fraternities can enter into contracts with their host school that imposes different, including harsher rules. If so, then they may have agreed to this, in exchange for being part of campus life. In terms of "discrimination," there can be causes of action for discrimination on the basis of nationality and race. This type of discrimination is only permitted if there is a compelling reason. You didn't mention that that was at issue. For discrimination between greeks vs. non-greeks, all that a public university needs to show is a reasonable basis for doing so. E.g, there have been past instances of rowdy greek parties. I'd say that likely is legal.

Unfortunately, that is the result when you are not married. Palimony now requires a written agreement. You are certainly entitled to child support and a share of the value of any jointly held assets. But marriage has certain advantages (and some disadvantages) that unmarried relationships do not.

I am in a situation to where my 18 year old son which is still in school went to live with his mother. Now in the Divorce Decree it had stated that our children were to live with me and she paid 50.00 a month per child in child support. I received a phone call from Harris County telling me that my son needed to be living with me since the divorce decree stated so. The Divorce Decree also stated that she was to pay child support till the age of 18. Why is it that he is not able to live with his mother and her not pay the 50.00 a month child support for him?

Was it CPS? If so, there has been a problem at her house and CPS wants him to leave her home.
Technically if the child is over the age of 18 he is now considered an adult. He can do whatever he wants. The Divorce Decree ends when he turns 18 - expect for child support that would continue until he graduates from high school or a court determines that it should stop.
I recommend that you talk to a family law attorney in your county. I assume that it is Harris County.
