Question

I'm in the process of dissolving my marriage. My spouse is homeless and we have no community property or community assets together. I just received an inheritance and am having a trust and will made. How will they word that? Married?

Answer

An inheritance is separate property. It has no impact on your divorce unless you transmute it into community property. You should put the inheritance into an account in just your name.

Answer

The estate plan should spell out that you are married but are in the process of divorcing your spouse and that you have intentionally made no provision for him or her.
